4787ORDINANCE NO. 4787 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW SECTION 1.12.015 TO CHAPTER 1.12 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE RELATING TO PUBLIC MEETING PROCEDURES. WHEREAS, certain revisions to the Ralph M. Brown Act (Government Code Section 54950, et seq.) will become effective on January 1, 1987, which revisions will require all legislative bodies as defined in said Act to comply with certain new procedures relating to the notice and conduct of public meetings; and WHEREAS, the City Council of the City of Anaheim desires to adopt the procedures hereinafter set forth to implement the revisions to the Ralph M. Brown Act contained in Chapter 641 of the 1986 Statutes of the State of California; and WHEREAS, Section 510 of the Charter of the City of Anaheim authorizes the City Council to adopt reasonable rules and regulations by ordinance relating to citizen participation in City Council meetings. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That new Section 1.12.015 be, and the same is hereby, added to Chapter 1.12 of Title 1 of the Anaheim Municipal Code to read as follows: "1.12.015 CITY COUNCIL MEETING PROCEDURES. .010 The City Clerk is hereby designated and directed to post any public notices, agendas, and other matters required to be publicly posted pursuant to any applicable provision .of the law including but not limited to agendas for regular meetings and other matters required to be posted pursuant to Sections 54954.2(a), 54956, and 54956.5 of the Government Code of the State of California. .020 Every agenda for regular meetings of the City Council shall provide an opportunity for members of the public to directly address the City Council on items of interest to the public that are within the subject matter jurisdiction of the City Council. .030 No resident or property owner within the City of Anaheim shall be denied the right to be heard by the City Council. .040 Unless otherwise waived by the City Council, the total amount of time allocated for public testimony on a particular issue shall not exceed ten (10) minutes and the amount of time for each individual speaker shall not exceed three (3) minutes". .050 The procedures and rules set forth in subsections .020, .030, and .040 above shall not apply to, nor be a limitation upon, any testimony given to the City Council in any hearing required by law. SECTION 2. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
