RES-2010-012RESOLUTION NO. 2010- 012 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MODIFYING THE RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION NO. 71 -478 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 2009 -077. WHEREAS, the City of Anaheim (Anaheim) maintains an electric generation and distribution system for the furnishing of electricity to residents and businesses of the City of Anaheim and has adopted Electric Rates, Rules and Regulations for the sale and distribution of electricity; and WHEREAS, the Anaheim Municipal Code authorizes the City Council to approve reasonable Rates, Rules and Regulations governing electric services and fees and charges for providing electric services; and WHEREAS, on December 3, 2009 and December 10, 2009, notice of the public hearing to modify the Electric Rates, Rules and Regulations was published in the Anaheim Bulletin and proof thereof is on file with the Secretary of the Public Utilities Board; and WHEREAS, on November 27, 2009 and December 4, 2009, notice of the public hearing to modify the Electric Rates, Rules and Regulations was published in the Orange County Register and proof thereof is on file with the Secretary of the Public Utilities Board; and WHEREAS, the Public Utilities Board held a public hearing on December 16, 2009, and evidence was presented in support of the modifications to the Electric Rates, Rules and Regulations; and WHEREAS, the Public Utilities Board considered the proposals of the Public Utilities Department and considered the evidence presented at the public hearing; and WHEREAS, the Public Utilities Board made the following findings with respect to the need for the proposed modifications to the Electric Rates, Rules and Regulations: 1. Section 1221 of the City Charter provides that utility rates charged to a class of customers shall be uniform within the class and shall be based on the cost of service revenue requirement for the class. 2. Section 1221 of the City Charter requires that the Utility rates shall be sufficient in order to allow the Utility to pay for operations and maintenance of the system; for payment of principal and interest on debt; for creation and maintenance of financial reserves adequate to assure debt service on bonds outstanding; for capital construction of new facilities and improvements of existing facilities, or maintenance of a reserve fund for that purpose; and for payments to the general fund of the City in the amounts set forth in the City Charter. 1 3. Section 1221 of the City Charter also provides that the City Council shall periodically review rates to insure that financial goals are being accomplished. 4. Section 1221 of the City Charter provides that the City Council may establish and revise ratepayer discounts and other programs to assist residential customers in the payment of their utility bills. 5. In setting rates, it is reasonable and appropriate to recognize the benefits that Anaheim Public Utilities customers will realize through having rates for domestic and non - domestic customers remain competitive with other local providers. 6. The City of Anaheim has not increased electric base rates since 2008 due to various active cost containment measures and by financing capital expenditures with low cost, tax - exempt debt financing. 7. The nature of some electric costs, such as gas fuel and purchased power, has changed from volatile short term costs to long term structural costs. In The Power Commodity Adjustment (PCA) which is a component of Schedule RSA (Rate Stabilization Adjustment) recovers electric costs that are subject to short term volatility, while base rates recover the long term structural costs. As the Electric Utility successfully negotiates long term contracts, the appropriate means of collecting for those costs moves from the PCA to base rates. 8. It is reasonable and appropriate to make modifications to electric base rates such as those set forth in Attachment A as these modifications are needed by the Electric Utility to preserve and maintain appropriate cost based rate structures, maintain competitiveness with other local utilities, maintain appropriate cash reserve balances to maintain bond covenant ratios, and to minimize the Electric Utility's risk exposure. 9. It is reasonable and appropriate to modify Schedule GS -2 (General Service) and Schedule TOU (Time -of -Use) to add a new High Voltage ( >50kv) rate for customers that wish to have energy delivered at voltage levels above 50 kV as customers served at higher voltage levels save the Electric Utility money on reduced infrastructure and generation costs so those cost savings should be passed on to those customers. 10. It is reasonable and appropriate to modify the Developmental Schedule EDBR (Economic Development/Business Retention) rate to encourage potential customer participation by re- opening this rate to encourage economic development within the City and by eliminating the load factor limitations to encourage greater participation by commercial and industrial customers. OA 11. It is reasonable and appropriate to modify Schedule GS -2 (General Service) and Schedule TOU (Time -of -Use) concerning the billing demand measurement intervals so that all customers are measured in fifteen (15) minute intervals as this will ensure uniformity and consistency in customer metering. 12. It is reasonable and appropriate to modify Rule No. 9 (Rendering and Payment of Bills) as set forth in Attachment B in order to implement a one percent (1 %) Late Payment Charge on the electric balance of the customer bill which remains unpaid after its due date as this will allow Customer Service to increase the amount of time distressed customers have to set up a payment plan before electric service is discontinued. WHEREAS, the proposed modifications to the rates as set forth in Attachment A and Rule No. 9 as set forth in Attachment B, and as more fully set forth in the text of each of the respective rate schedules and Rule No. 9, all of which are on file with the Office of the City Clerk, are necessary and appropriate to meet the requirements of the City Charter as the modifications will ensure adequate revenues necessary to meet power supply costs, operations and maintenance expenses, capital expenditures, debt service requirements, reserve amounts, and other necessary costs; and WHEREAS, the Public Utilities Board considered the requirements of the California Environmental Quality Act and found that matters covered above come within Section 21080 (b)(8) of the Public Resources Code of the State of California. Thus, the modification of these rates and Rule No. 9 are statutorily exempt from the California Environmental Quality Act; and WHEREAS, based on the findings hereinabove made, the Public Utilities Board of the City of Anaheim recommends to the City Council that the City Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the modifications to the Electric Rates, Rules and Regulations as reflected in Attachment A and Attachment B, and as more fully set forth in the text of each of the respective rate schedules and Rule No. 9, all of which are on file with the Office of the City Clerk; and WHEREAS, based on the finding hereinabove made, the Public Utilities Board of the City of Anaheim recommends to the City Council that the City Council, by Motion, certify that the modifications to the Electric Rates, Rules and Regulations are statutorily exempt under the California Environmental Quality Act, Public Resource Code, Section 21080 (b)(8), in accordance with Title 14 of the California Administrative Code, Section 15273(a); and WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabove. NOW, THEREFORE BE IT RESOLVED that: 1. The findings of the Public Utilities Board as set forth herein are hereby adopted by the City Council of the City of Anaheim. 3 2. The modifications to the Electric Rates, Rules and Regulations shall be, and are hereby adopted by the City Council of the City of Anaheim with the modified rates to become effective February 1, 2010 as reflected in Attachment A and the modified Rule No. 9 to become effective March 1, 2010 as reflected in Attachment B, and as more fully set forth in the text of each of the respective rate schedules and Rule No. 9, all of which are on file with the Office of the City Clerk. 3. The Public Utilities General Manager is hereby authorized and directed to prepare, promulgate, publish, and implement changes to the Electric Rates, Rules and Regulations as set forth herein. Lifeline service shall be made available only to domestic service billed on Schedule Nos. DS, DSM and DSMS. 2. Eligibility. All domestic customers on Schedules Nos. DS, DSM and DSMS are entitled to an allocation of a lifeline quantity of electricity which is necessary to supply the minimum energy needs of the average residential user: a. For basic residential use; and b. If qualified, for water heating and space heating; and, e. If qualified, for an essential life- support device used by a full -time resident of a residential household. . Basic Residential Use. Each eligible domestic customer will be allowed a lifeline quantity of electricity for lighting, cooking, and food refrigerating, which is specified as basic residential use. The lifeline quantity of electricity for base residential use is set forth on the applicable rate schedules and is to be billed at the rates designated. 4. Water Heating. Each eligible domestic customer may be allowed an additional lifeline quantity of electricity for water heating, upon application to the Utility if electricity is the domestic customer's primary source for water heating. The lifeline quantity of electricity for water heating is set forth on the applicable rate schedule and is to be billed at the rates designated. 5. Space Heating. Each eligible domestic customer may be allowed an additional lifeline quantity of electricity for space heating for service rendered during the months of November through April, inclusive, upon application to the Utility if electricity is the domestic customer's primary source for permanently- installed space heating. The lifeline quantity of electricity for space heating is to be billed at the rates designated. 6. Life- Support Devices in Customer's Residence. Each eligible domestic customer may be allowed an additional lifeline quantity of electricity, upon application to the Utility where such customer provides certification that a full -time resident of the household regularly requires the use of an essential life- support device, such as a respirator, iron lung, or kidney dialysis machine. The customer have a medical doctor or osteopath licensed to practice medicine in the State of California providing the Utility with a letter, acceptable to the Utility, describing the type of regularly required life - support device and the utilization requirements in detail; or b. County, State, or Federal agencies, using an established notification letter to electric utilities, provide the Utility with information relative to patients who regularly require the use of a life - support device in the home. Upon the above certification, the Utility shall estimate the monthly consumption of the particular life- support device, given the usual hours of operation per month, and within 30 days add the incremental estimated monthly usage to the customer's lifeline quantity. The Utility may require a new or renewed application and/or certification when needed, in the opinion of the Utility. 8. Verification. Not more than one lifeline quantity will be allowed for each single- family dwelling or accommodation on the premises for each of the end uses set forth in Paragraphs 3, 4, 5 and 6 above. However, where theme are multiple life- support devices at such single - family dwelling or accommodation, all such certified devices shall be totaled for one lifeline quantity. The number of single-family accommodations on the premises and the existence of the specified end use equipment required to obtain certain lifeline quantities of electricity, as set forth on the applicable rate schedules, are subject to verification by the Utility. In the event the Utility ascertains that the customer is not eligible for such additional lifeline quantity, such customer may be rebilled as if no such additional lifeline quantity had been allowed. 9. Termination of Use. Customers shall give the Utility notice of termination of use of equipment or devices set forth in Paragraphs 4, 5, and 6 above. 10. Billing. The customer charge and the energy charge shall be billed in the appropriate blocks at the rates designated as applicable to lifeline service up to the total of the applicable lifeline quantities as determined in accordance with Paragraphs 3, 4, 5 and 6 above. Usage in excess of the total applicable lifeline quantities shall be billed in the blocks continuing from the point reached by the total of the applicable lifeline quantities at the rates designated. In addition, all kilowatt -hours sold shall be subject to the Rate Stabilization Adjustment. B. Multi- Family Accommodations Where all of the single - family accommodations in an apartment house, court group, or similar multifamily accommodations are on a single meter, the customer shall have the following options: I . To be billed in General Service Schedules GS -1 or GS-2; or 2. To be billed on the applicable DSM or DSMS rate of this schedule. C. Rate Stabilization Adjustment The rates above are subject to adjustment as provided in Schedule RSA. Where the demand is intermittent or subjected to violent fluctuations, the maximum demand may be based on a lesser interval, E. A maximum demand meter will be installed when, in the opinion of the Utilities Department, the customer's load and use characteristics indicate that the maximum demand may exceed 15 kW or when the customer requests a demand rate. Billing Demand GENERAL SERVICE Page No. 2.3.2 Demand will be measured at 15 minute intervals, by instruments supplied, owned and maintained by the City. The billing demand will be the greater of: 1) the highest average kilowatt input for the billing period; 2) 50% of the contracted for or connected load; or, 3) 50% of the highest billing demand in the preceding I 1 billing periods. However, in no case shall the billing demand be less than 200 kW. Where the demand is intermittent or subjected to violent fluctuations, the maximum demand may be based on a shorter interval. C. Power Factor Adjustment The charges will be adjusted each month for the power factor as follows: The charges will be increased by 28 cents per kilovar of reactive demand. The kilovars of reactive demand shall be calculated by multiplying the kilowatts of measured maximum demand by the ratio of the kilovar -hours to kilowatt- hours. Demands in kilowatts and kilovars shall be determined to the nearest unit. A ratchet device will be installed on the kilovar -hour meter to prevent its reverse operation on leading power factor. D. Voltage Discount The charges, excluding the Customer Charge, Power Factor and Rate Stabilization Adjustment, will be reduced by 3% for service delivered at voltages from 2 to IOKV; by 6% for service delivered at voltages from 11KV to 50KV; customer equipment and metering per Department standards. For service delivered at levels above 50 kV all charges will be assessed as set forth in the schedule above. E. Temporary Discontinuance of Service Where the use of energy is seasonal or intermittent, no adjustment will be made for a temporary reduction of load. Any customer who resumes service within twelve months must pay all charges that would have been billed had service been continuous. F. Rate Stabilization Adjustment The rates above are subject to adjustment as provided for in Schedule RSA. The applicable billing factor set forth therein will be applied to all kilowatt-hours billed under this rate schedule. G. X -Ray installation Where the City installs the standard transformer capacity requested by a customer to service separately an X -ray installation, the customer charge will be increased by $1.00 per kva of transformer capacity requested. Applicable to This Rate Schedule Only If a customer on this developmental rate schedule finds that it is less advantageous to the customer to be on this developmental rate schedule than the normal Schedule D, Domestic Service, the customer may request to be returned to Schedule D, Domestic Service. Appropriate billing adjustments may be made at the sole discretion of the Public Utilities General Manager for the period that the customer was on this developmental rate schedule. D. Bills for electric service will be rendered bimonthly, monthly or as otherwise provided in the tariff schedules. 2. Metered Service. a. Bills for metered service will be based on meter registrations. Meters will be read as required for the preparation of regular bills, opening bills and closing bills. b. If, because of unusual conditions or for reasons beyond its control, the Utility is unable to read the meter on the scheduled reading date, the Utility may bill the customer /those deriving the benefit of service for estimated consumption during the billing period, and make any necessary corrections when a reading is obtained. Estimated consumption for this purpose will be calculated considering the customer's prior usage, the Utility's experience with other customers of the same class in that area, and the general characteristics of the customer's operations. Adjustments for any underestimation or overestimation of a customer's consumption will be reflected on the first regularly scheduled bill rendered and based on an actual reading following any periods when estimation was required. When a service start date can be reliably estimated, the undercharge can be computed back to that date, exclusive of Rule #17. Access to the meter, sufficient to permit its being read shall be provided by the customer as a prerequisite to the Utility making any adjustment of consumption billed on an estimated bases. 3. Unmetered Service. A flat rate may be applied upon request (in writing) where the applicant for service has a fixed connected load to be operated over a fixed number of hours during a billing period, and where the following conditions are met: a. Provision has been made to prevent any additional consumption on the service. b. The point of interconnection of the service is approved by the Utility. C. Such service may be supplied under any appropriate rate schedule at the Utility's operating convenience and all conditions of the rate schedule shall apply, including the Power Cost Adjustment/Rate Stabilization Account. 4. Pro rata Computation. All bills for electric service rendered will be computed in accordance with the applicable thirty -day rate schedule. but the size of the energy blocks and the amount of the customer, service, demand or minimum charge, specified therein, will be prorated on the basis of the ratio of the number of days service has been rendered to the number of days in an average month of thirty days. READINGS OF SEPARATE METERS NOT COMBINED Page No. 3.9.2 For the purpose of billing, each meter upon the customer's premises will be considered separately, and the readings of two or more meters will not be combined, except as follows: L Where combinations of meter readings are specifically provided for in the tariff schedules. 2. Where the Utility's operating convenience requires the use of more than one meter. C. PAYMENT OF BILLS 1. All bills are due upon receipt. Payment shall be made at the City of Anaheim, Division of Collections. 2. Bills for connection or reconnection of service and payments for deposits or to reinstate deposits as required under the rules of the Utility shall be paid before service will be connected or reconnected. 3. Customers applying to receive their electric power and ancillary services from an Energy Service Provider (ESP), will be required to pay the Utility past due charges prior to processing of their application. 4. Customers receiving their electric power and ancillary services from an ESP and wishing to reinstate the Utility as their service provider, will be required to pay all the Utility past due charges prior to processing of their application. D. RETURNED CHECK CHARGE The Utility may require payment of a returned check charge equal to that permitted under the City of Anaheim Municipal code for any check or other negotiable instrument returned from the bank unpaid. E. FUND VERIFICATION FEE A Fund Verification Fee may be charged to customers paying by personal check if the Utility deems it necessary to verify that the customer has sufficient funds in his/her account when: (1) the customer has been disconnected for non - payment of service or (2) the customer has a history of non - sufficient funds in his/her account. This fee is contained in Rule 23. F. LATE PAYMENT CHARGE A late payment charge of 1.0% may be applied to the total unpaid balance of a domestic or nondomestic Customer account if the Customer's payment is not received by the date indicated on the Customer account bill or summary bill.
