RESOLUTION NO. 86R-129
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED CONVEY-
ING TO THE CITY OF ANAHEIM CERTAIN REAL PROP-
ERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES. (R/W '3292-3)
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property
for municipal purposes, to wit: An easement for road and public
utility purposes; and
WHEREAS, the owner of said property has offered to sell
and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of
Anaheim to accept said offer and purchase said real property~
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of JAMES A~ GIBSON to sell to
the City of Anaheim the following described real property
situated in the City of Anaheim, County of Orange, State of
California, to be used for an easement for road and public
utility purposes, and more particularly described as follows:
A public utility easement for Sanitary Sewer
purposes, including all reasonable rights of ingress
and egress for the installation and maintenance of
sanitary sewers and related facilities over, under,
along, across and through those portions of Lot 1A
and Lot lB as shown on a Record of Survey as per map
filed in Book 82, page 26 of Record of Surveys, in
the office of the County Recorder of said Orange
County, described as follows:
Parcell: That portion of that certain 40.00 foot
wide easement for road purposes as recorded in Book
1919, page 314, Official Records of said Orange
County lying within said Lot lA and Lot lB of the
above described Record of Survey.
Parcel 2: That portion of said Lot 1A of the above
described Record of Survey lying parallel with and
10.00 feet northerly, as measured at right angles to
the following described line:
Beginning at the southeast corner of said Lot lA,
said corner also being the True Point of Beginning;
thence N 62 degrees 23' 30" W, 98.62 feet to a point
of terminus.

Grantor hereby also grants a Temporary Construction
Easement together with all reasonable rights of
ingress and egress over the northerly 15~OO feet of
the southerly 25.00 feet of that portion of said Lot
IA of the above described Record of Survey being
parallel with and measured at right angles to the
following described line:
Beginning at the southeast corner of said Lot lA~
said corner also being the True Point of Beginning;
thence N 62 degrees 23' 30" W, 98.62 feet to a point
of terminus.
This Temporary Construction Easement is for the
purpose of the construction and installation of the
sanitry sewer facilities. Said Temporary
Construction Easement to termiate and shall become
null and void and cease to exist upon completion of
the construction of said sewer facilities,
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property; provided, however, that nothing herein shall be
construed to be an acceptance of any parcel or property into the
City street system (Section 1806, Streets and Highways Code).
BE IT FURTHER RESOLVED that the Accounting Officer of
the City of Anaheim be, and he is hereby, authorized to issue a
warrant and pay to the owner of said real property, out of General
Funds of the City of Anaheim and charged to Account No.
ll-790-7l01-EOSOO the sum of Three Hundred Dollars ($300~00)~
THE FOREGOING RESOLUTION is approved and adopted by the
Ci ty Council of the Ci ty of Anaheim this 1st day of April, 1986.
