86R-130 RESOLUTION NO. 86R-130 A RESOLUTION OF THE CITY OF ANAHEIM AUTHORIZING THE CITY MANAGER TO BIND THE CITY FOR THE ACQUISITION OF EQUIPMENT~ MATERIALS, LABOR AND SERVICES IN THE EVENT OF EMERGENCY SITUATIONS REQUIRING IMMEDIATE WORK ON THE CITY UTILITY SYSTEMS~ WHEREAS, from time to time, the City of Anaheim requires the services of independent contractors to assist the City in emergency circumstances when the City has an insufficient number of personnel to maintain and/or restore service during such emergencies; and WHEREAS, the City desires to expedite the securing of services of contractors having sufficient manpower to assist the City during such emergencies; and WHEREAS, pursuant to City of Anaheim Charter Section 518, the City Council may authorize the City Manager to bind the City for the acquisition of equipmentt materials, supplies, labor, services or other items included within the budget approved by the City Council. . NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Anaheim that the City Manager is authorized during the existence of an emergency declared by the Public Utilities General Manager to negotiate on behalf of the City of Anaheim and bind the City for the acquisition of equipment, materials, supplies, labor, services, or other items needed in emergency circumstances subject to the following conditions: (1) that there are sufficient funds in the current Resource Allocation Plan to compensate contractors for materials and services performed; and (2) an emergency, in the opinion of the Public Utilities General Manager, exists to such an extent that the City of Anaheim Public Utilities Department does not have a sufficient number of personnel to maintain and/or restore service during such emergency; and (3) Any agreement entered into by the City Manager pursuant to the authority granted by this Resolution shall expire on the date of the next regular city council meeting.
