RES-2010-018RESOLUTION NO. 2010- 018 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM PROVIDING A PARTIAL REBATE OF THE CITY OF ANAHEIM'S LOCAL SALES TAX TO ENCOURAGE AND PROMOTE MAJOR PURCHASES WITHIN THE CITY OF ANAHEIM WHEREAS, the Bradley -Burns Local Sales and Use Tax Law establishes a maximum rate for a city sales and use tax rate of one percent and authorizes the State Board of Equalization to collect the tax; and WHEREAS, Section 2.04.040 of the Anaheim Municipal Code establishes a sales tax rate of one percent of the gross receipts of the retailer from the sale of all tangible personal property sold at retail in the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim hereby desires to establish and promote a program (known as the "Anaheim Purchase Incentive ") to encourage and promote certain taxable transactions by providing a rebate of half of the local sales tax (equal to one -half of one percent) on all taxable purchases greater than or equal to $20,000 within the City. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Anaheim as follows: 1. That the effective period of the Anaheim Purchase Incentive program resulting in the rebate of the local sales tax otherwise receivable by the City of Anaheim shall apply to any taxable purchases greater than or equal to $20,000 made between February 10, 2010, and June 30, 2010, and that such application for rebate must be received by the City of Anaheim by July 31, 2010. 2. Except as expressly set forth herein, nothing in this Resolution shall be deemed to refund any other fees or taxes charged by or due to the City of Anaheim or any other taxing entity. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 9 day of February, 2010, by the following roll call vote.
