86R-198 RESOLUTION NO. 86R-198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ANAHEIM AND THE ANAHEIM POLICE ASSOCIATION. WHEREAS, on January 31, 1984 the City Council approved Resolution No. 84R-49 adopting a Memorandum of Understanding between the City of Anaheim and the Anaheim Police Association; and WHEREAS, the City Management Representative has met and conferred with staff officials of the Anaheim Police Association to discuss a reduction of retirement benefits for future local police members; and WHEREAS, as a result thereof, a Letter of Understanding dated February 18, 1986 between the parties which establishes a reduction of PERS pension benefits and creates a supplemental deferred compensation program for future local police members has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that adoption of said Letter of Understanding is in the best interest of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated February 18, 1986 between the City of Anaheim and the Anaheim Police Association is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day of Mav , 1986. LETTER OF UNDERSTANDING BETWEEN THE CITY OF ANAHEIM AND ANAHEIM POLICE ASSOCIATION In accordance with the intent of the Memorandum of Understanding between the CITY OF ANAHEIM and the ANAHEIM POLICE ASSOCIATION, the parties have met to discuss P.E.R.S. pension benefits for all police employees hired on or after November 1, 1985. The CITY and the ANAHEIM POLICE ASSOCIATION hereby agree that all police employees hired on or after November 1, 1985, shall receive the following P.E.R.S. pension benefits: 1. Unit employees are eligible to participate in a supplemental deferred compensation program under the following conditions: 1.1 An employee may contribute up to five percent (5%) of the employee's annual gross PERS eligible compensation in any single year, to the City's existing deferred compensation program. Employees shall not carryover to succeeding years unused portions of the five percent annual contribution limit. 1.2 All contributions pursuant to this program will be accounted for separately from other contributions made by the employee to the deferred compensation program. However, all accounts shall be calculated as one for purposes of establishing tax deferral limits. 1.3 On the date an employee commences a PERS Service Retirement, the City will match the funds held in such separate account subject to the following preconditions: 1.31 The Employee must apply for and receive a PERS Service Retirement. 1.32 The Emp10yee must 1eave City service. 1.33 The Employee must have ten (10) years of service with the City; and 1.34 The Employee must be covered by the PERS plan described in 2.1. (Employees receiving 2% Age 50 Benefits are not eligible for this plan. ) 1.4 City funding of said "matching funds" shall be open to inspection, review, and audit by participants upon reasonable advance notice. 1.5 City "matching funds" will be distributed upon retirement of the employee subject to prevailing laws, rules, or regulations. 1.6 This supplemental deferred compensation program shall be a component of the deferred compensation program and 1s subject to all current and future laws, rules and regulations pertaining to such plan. 2. Employees hired on or after November 1, 1985, shall be provided with the following PERS pension benefits: 2.1 The basic PERS plan with two percent at age 55 benefits: 2.11 The basic PERS plan with three year final averaging; and 2.12 The basic PERS plan with 1959 survivors benefits equivalent to the current plan. 2.2 Anaheim will pay the City contribution and the Employees' 7% contribution for this plan. The Employees' 7% contribution shall be made on behalf of the participants covered under section 2.1 of this agreement in whose name said contributions shall vest automatically. 3. Contingent upon the approval of P.E.R.S., employees will be given a one time irrevocable opportunity before October 9, 1986, to convert from the current PERS plan to the plan described in section 2.1.
