A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING PROPERTY TAX EXCHANGE
AGREEMENT BETWEEN THE CITY OF ANAHEIM AND
THE COUNTY OF ORANGE REGARDING THE
BROADWAY /THISTLE ISLAND ANNEXATION (RO 10-
01) TO THE CITY OF ANAHEIM.
WHEREAS, twenty (20) landowners filed petitions with the Local Agency Formation
Commission for annexation of unincorporated territory located in the City of Anaheim's sphere
of influence; and
WHEREAS, the proposed annexation is substantially surrounded by the City of Anaheim
(also referred to herein as "City "), and is generally located to the west of Brookhurst Avenue, to
the east of Rosebay Street, south of Broadway Avenue, and north of Clearbrook Street; and
WHEREAS, a map depicting the area of Annexation No. RO 10 -01 is attached hereto and
designated as the Broadway /Thistle Area Vicinity Map; and
WHEREAS, California Revenue and Taxation Code Section 99 allows cities and counties
to adopt and approve property tax exchange agreements to set forth the exchange of such
revenues following the addition to a city of previously unincorporated territory; and
WHEREAS, the City shall receive 100% of the Structural Fire Fund and 100% of the
Library Fund generated in the annexed areas upon annexation; and
WHEREAS, the County and City staffs have reached agreement, subject to City Council
and Board approval, regarding the exchange of property tax as a result of the annexation of the
Broadway /Thistle Island unincorporated area by the City, whereby upon annexation by the City,
the City shall receive 42.4742% of the property tax and the County of Orange (also referred to
herein as "County ") shall receive 57.5258% of the County's share of the 1% basic levy of
property tax generated within the area to be annexed, pursuant to Master Property Tax Transfer
Agreement 80 -2034; and
WHEREAS, the City staff and the County Staff desire to have the same adopted and
approved by their respective governing bodies.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim
does hereby approve the property tax exchange agreement reached between the City of Anaheim
and the County of Orange, whereby, upon completion of the annexation of the Broadway /Thistle
Island unincorporated area to the City of Anaheim, City shall receive 42.4742% and the County
of Orange shall receive 57.5258% of the County's share of the 1% basic levy of property tax
from the annexed area pursuant to Master Property Tax Transfer Agreement 80 -2034.
BE IT FURTHER RESOLVED that the City of Anaheim will receive 100% of the
Structural Fire Fund and 100% of the Library Fund generated in the annexed areas upon
annexation.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 13th day of April , 2010, by the following roll call vote:
