RES-2010-044RESOLUTION NO. 2010- 044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PUBLIC UTILITIES GENERAL MANAGER OR HER DESIGNEE TO ACCEPT ON BEHALF OF THE CITY OF ANAHEIM AN ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT FROM THE DEPARTMENT OF ENERGY FOR VARIOUS ENERGY CONSERVATION PROJECTS, EXCUTE ALL REQUIRED DOCUMENTS INCLUDING THE ASSISTANCE AGREEMENT, AND TAKE SUCH ACTIONS IN FURTHERANCE OF THE GRANT, AND AMENDING THE BUDGET FOR FISCAL YEAR 2009/2010 ACCORDINGLY. WHEREAS, the Public Utilities Department (the "Department ") engages and plans to engage in numerous energy conservation projects ( "Energy Conservation Projects ") throughout the City of Anaheim; WHEREAS, in June 2009, Department staff applied for Energy Efficiency and Conservation Block Grant ( "EECBG ") funds with the Department of Energy (DOE) to support and /or enhance the Energy Conservation Projects; WHEREAS, in October 19, 2009, the DOE informed the Department that it approved its EECBG grant application in an amount of $3,254,800; WHEREAS, the City of Anaheim, a municipal corporation and charter city (the "City "), is familiar with the terms, conditions, and limitations of EECBG Award No. DE- EE0000861 (the "EECBG Grant "); and WHEREAS, the City is willing and able to accept the EECBG Grant and conform to each of its teens, conditions, and limitations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The City Council of the City of Anaheim hereby agrees to, and by this Resolution, does hereby accept the EECBG Grant. 2. The City of Anaheim hereby agrees to comply with each and all of the teens, conditions, and limitations imposed by the DOE upon the EECBG Grant. 3. The Public Utilities General Manager, or her designee, is hereby authorized to accept the EECBG Grant on behalf of the City of Anaheim and use the grant funds for the Energy Conservation Projects. 4. The Public Utilities General Manager, or her designee, is hereby authorized and directed, on behalf of Anaheim, to take such actions and execute any such assurances, payment requests, plans, and agreements, including but not limited to, the Assistance Agreement and the Special Terms and Conditions as may be necessary for the purpose of obtaining funds under the EECBG Grant. 5. The Public Utilities General Manager, or her designee, is hereby authorized and directed to carry out any other actions in furtherance of the EECBG Grant, including, but not limited to, the execution of any agreements and take such actions as are necessary or required to implement and administer the EECBG Grant. 6. The annual budget of the City of Anaheim for Fiscal Year 2009/2010 is hereby amended by increasing the appropriations and authorized expenditures in such amount equal to the amount of EECBG Grant to be received by Anaheim. 7. The City Council hereby determines and finds that, in accordance with the California Environmental Quality Act (CEQA) and the State CEQA Guidelines, the adoption of this Resolution by the City Council is exempt from CEQA pursuant to State CEQA Guidelines sections 15060(c)(2), 15061(b)(3) and 150301 because (i) the activity approved by this resolution will not result in a direct or reasonably foreseeable indirect physical change in the environment; (ii) it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment; and (iii) the activity approved by this resolution involves the minor alteration of existing facilities and does not expand existing uses. City staff is hereby directed to file with the County Clerk a Notice of Exemption within three business days of the adoption of this Resolution.
