RESOLUTION 2010- 045
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING THREE PUBLIC UTILITY EASEMENTS
LOCATED AT 1761 WEST KATELLA AVENUE PURSUANT TO
CALIFORNIA STREETS AND HIGHWAY CODE SECTION 8330,
ET SEQ. - SUMMARY VACATION. (Abandonment No. ABA
2010- 00182)
WHEREAS, an applicant has requested the vacation of three public utility easements
located at 1761 West Katella Avenue, Anaheim California, in order to clear title to the parcel of land;
and
WHEREAS, the public service easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the three public utility easements, as set forth as follows:
(1) a public utility easement recorded November 18, 1993 as instrument number 83- 533065 of
Official Records, Orange County, State of California; (2) a public utility easement recorded March
27, 1985 as instrument number 85- 106533 of Official Records, Orange County, State of California;
and, (3) a public utility easement recorded February 21, 1991 as instrument number 91- 078300 of
Official Records, Orange County, State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 27th day of April , 2010, by the following roll call vote:
AYES: Mayor Pringle, Council Members Sidhu, Hernandez, Galloway, Kring
