86R-275 RESOLUTION NO. 86R-275 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION AND COMPLETION OF A PUBLIC WORK. WHEREAS, public convenience and necessity require the construction and completion of a public improvement (Project) in the City of Anaheim described in Exhibit A attached hereto and incorporated by reference herein; and WHEREAS, the City Council instructed the Public Works Department to prepare or cause to be prepared detailed designs, plans, profiles, drawings and specifications, and estimates of quantities and costs and make necessary surveys for the construction of said Project; and WHEREAS, said Public Works Department has prepared or caused to be prepared said detailed designs, plans, profiles, drawings and specifications for the construction of said Project and has submitted the same to the City Council; and WHEREAS, the City Council finds that said detailed designs, plans, profiles, drawings and specifications for said Project above mentioned are in accordance with good engineering practice and are adequate to serve the needs and requirements of the City of Anaheim and the citizens and residents in said area for the purposes for which they are intended, and that they are adequate for the construction of said Project and should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the detailed designs, plans, profiles, drawings and specifications for said Project hereinabove mentioned and described be, and the same are hereby, approved and adopted. BE IT FURTHER RESOLVED that said Project shall be constructed in accordance with said detailed designs, plans, profiles, drawings and specifications as hereby approved, and such addenda or modifications thereto as may be approved prior to the awarding of bids therefor. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to publish a notice according to law, inviting sealed proposals for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct a~d complete, in a good and workmanlike manner, in strict accordance with said detailed designs, plans, profiles, drawings and specifications the Project hereinabove mentioned and described, and fixing the Bid Opening Date as set forth in Exhibit A at the hour of 2:00 o'clock P.M. as the date and hour for the opening of said bids at the City Council Chamber in the Civic Center in the City of Anaheim. BE IT FURTHER RESOLVED that the successful bidder or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by the City Attorney of the City of Anaheim for the construction, installation and completion of said Project hereinabove mentioned and described, in accordance with the plans and specifications, the notice inviting sealed proposals, this resolution and all applicable City Ordinances or Code Sections and the laws of the State of California, and shall be required to post bonds and insurance in the amounts and within the time required by law, as specified in the notice inviting sealed proposals, and in a form approved by the City Attorney. I EXHIBIT A PROJECT: Pearson Park Amphitheater Courtyard in the City of Anaheim consisting of the development of a landscaped courtyard area in front of the Pearson Park Amphitheater and between the recently completed restroom and concession buildings. In addition to irrigation, landscaping and concrete work, the project will include overhead shade structures, special night lighting and a lighted fountain which will provide a focal and melting point for the patrons of the facility. The entire courtyard area will be enclosed in a concrete block and wrought iron fence, with a wrought iron rolling entry gate which will secure the area during special events or periods of non-use.
