1975-534RESOLUT ION NO, 7 S g_, j a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. i 5ra • WHEREAS, the City Planning Commission of the City of - Anaheim did receive an application for a conditional use permit from John rluish, agent for Recreational Vehicles Service Center rl, owner, to permit a recreational center on the following des- cribed aroperty: PARCEL A: PARCEL 1, IN THE CITY OF A3VAHEIiT, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A PARCEL MAP FILED IN BOOK 47 PAGE 17 OF PARCEL MAPS, IN THE OFFICE OF THE COLZTTY RIECORDER OF SAID COUNTY. PARCEL B: PARCEL 1, IIT THE CITY OF ANMEIX- j COUNTY OF ORANGE, STATE OF CALIFOR14IAl AS SHOWIN ON A PARCEL MAP FILED IN BOOK 55 PAGE 47 OF PARCEL i APS , IN THE OFFICE OF THE COUNTY ECORDER OF SAID COUNTY, AND WHEREAS, the City Planning Conaission did hold a public hearing at the City Hall in the City of Anaheim upon said application on se .tember 15 , 19 notices of which said public hearing were u given as r red b law and the P 4 Y 4 � Y provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS,, said Commnission , after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No, PC 5-191 90rilM, denying IConditional Use Pe t leo. 1564 an - 1 - WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said conditional use permit and said appeal was set for public hearing on October 14 , 19 75 , at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare, 4. The traffic generated by the proposed.use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in denying said conditional use permit be, and the same is hereby reversed , and that Conditional Use Permit No. 1564 be, and the same is hereby, granted permitting an outdoor recreation center on the aforedescribed property with waiver of the following sections of the Anaheim 11unicipal Code: SECTION 189619026 Permitted uses. (outdoor amusement facility not permitted) SECTION 18.61.86 8.4 30 Required enclosure of outdoor use. (bio screening propose:) '{ lint said Conditional Use Per.mit is granted subject to the follow- ing conditions: 2 - 1. That all air conditioning facilities shall be properly shielded from view p and the sound buffered from adjacent properties. 2. That trash storage areas shall be provided in accordance T�7itlZ approved 'dans on file with the Office of the Director of Pub- lic :works . 3. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire De- _0artment prior to conmiencement of structural framing. 40 ghat the lighting of subject property shall be oriented in Such a way as not to interfere with traffic on the Riverside Freeway; and that petitioner shall obtain a favorable letter from CalTrans indicating the Proposed lighting will not be detrimental nor hazardous to the safety of the freeway -traffic; and, further- more, that said letter shall be submitted to the Planning Department :prior to the comlencement or t��e activity authorized under this resolution. mhe City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner...s, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
