A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A TEN FOOT PUBLIC UTII,ITY
EASEMENT LOCATED AT 1041 SHEPARD STREET
(ABANDONMENT N0.2005-00114}
WHEREAS, the City Council of the City of Anaheimdid, byResolution No. 2005-
182, duly adopted, declare its intention to vacate certain public streets, highways or public service
easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and
WHEREAS, notice of a public hearing to consider said vacation was posted and
published in the manner prescribed bylaw; and
WHEREAS, on the 13th day of September, 2005, a public hearing was held to allow
interested persons to submit evidence concerning said proposed vacation.
WHEREAS, the abandonment approved herein does not convey right, title and
interest to the abandoned property, which is conveyed by separate quitclaim deed pursuant hereto.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of that certain 10 foot public utility easement for the
installation and maintenance of underground electrical conduit, conductors, transformers and related
electrical facilities as set forth in an Easement Deed recorded in Book 11702, Page 178 of Official
Records of the County of Orange, generally known as 1041 Shepard Street, Anaheim, California.
See Exhibits "A"and "B", attached hereto, for the legal description of the foregoing.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim thisday of octoher , 2005, by the following roll-call vote:
AYES: Mayor Pringle, Council Members Sidhu, Hernandez, Galloway, Chavez
NOES: None
ABSTAIN: None
