2005-212RESOLUTION N0. 2p05-212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE PLATINUM TRIANGLE MASTER LAND USE PLAN (MISCELLANEOUS CASE N0.2005-OOl 11) WHEREAS, on May 25, 2004, the City Council of the City of Anaheim adopted Resolution No. 2004-95 approving General Plan Amendment No. 2004-00419 in conjunction with the approval of Zoning Code Amendment No. 2004-00029, Reclassification No. 2004-00117, Amendment No. 5 to the Anaheim Resort Specific Plan No. 92-2 (SPN 2004-00023), Amendment No. 2 to the Northeast Area Specific Plan No. 94-1 (SPN 2004-00024), and other related actions; and adopted Resolution No.2004-94 certifying Final EIR No. 330, adopting a Statement of Findings and Facts and a Statement of Overriding Considerations and adopting the Mitigation Monitoring Programs (Mitigation Monitoring Program No. l22 for the General Plan and Zoning Code Update, the 1.ipdated and Modified Mitigation Monitoring Program No, lU6 for The Platinum Triangle and the Updated and Modified Mitigation Monitoring Program No. 0085a for the Anaheim Resort Expansion Area) associated with the project ("Final EIR No. 330"); and WHEREAS, General Plan Amendment No. 2004-00419 provided for a comprehensive citywide General Plan Update which included redesignating land use designations within an approximately 820-acre area generally bounded by the Santa Ana River on the east, the Anaheim City limits on the south, the Santa Ana Freeway (Interstate 5) on the west and the Southern California Edison Company right-of-way on the north (referred to as "The Platinum Triangle")from Commercial Recreation and Business Office/Mixed Use/Industrial to Mixed Use, Office High, Office Low, Industrial, Open Space and Institutional, generally corresponding to the property subject to the Anaheim Stadium Area Master Land Use Plan, except for approximately 1 S acres adjacent to the east side of the Santa Ana (I-5) Freeway, north of Katella Avenue and further depicted in Attachment A to Resolution No. PC2004-82; and WHEREAS, the adopted General Plan envisions The Platinum Triangle as a thriving economic center that provides residents, visitors and employees with a variety of housing, employment, shopping and entertainment opportunities that are accessed by arterial highways, transit tiystems and pedestrian promenades (set forth in Goal 15.1 of the Land Use Element); and WHEREAS, the recently adopted General Plan includes policies in the Land Use Element and the Community Design Element to implement the vision for The Platinum Triangle including providing for more detailed planning efforts to guide the future development of The Platinum Triangle; encouraging mixed-use projects integrating retail, office and higher density residential land uses; encouraging a regional inter-modal transportation hub in proximity to Angel Stadium of Anaheim; maximizing and capitalizing upon the view corridor from the Santa Ana (I-S) and Orange (SR-57) Freeways; maximizing views and recreation and development opportunities afforded by the area's proximity to the Santa Ana River; developing a comprehensive Mixed-Use Overlay Zone and Design Guidelines to implement the vision for The Platinum Triangle; providing for a mix of quality, high-density urban housing that is integrated into the area through carefully maintained pedestrian streets, transit connections, and arterial access; developing a Public Realm Landscape and Identity Program to enhance the visibility and sense of arrival into The Platinum Triangle through peripheral view corridors, gateways, and specialized landscaping; developing a strong pedestrian orientation throughout the area, including wide sidewalks, pedestrian paths, gathering places, ground-floor retail, and street-level landscaping; encouraging extensive office development along the highly visible periphery of the area to provide a quality employment center; developing criteria for comprehensive property management agreements for multiple-family residential projects to ensure proper maintenance as the area develops; and, identifying and pursuing opportunities for open space areas that serve the recreational needs of Platinum Triangle residents and employees; and WHEREAS, the originally adopted General Plan establishes a maximum development intensity for The Platinum Triangle for up to 9,175 dwelling units (at an intensity of up to 100 dwelling units per acre), 5,000,000 square feet of office space, 2,044,300 square feet of commercial uses, industrial development at a maximum floor area ratio of 0.50 and institutional development at a maximum floor area ratio of 3.0; and WHEREAS, the Platinum Triangle Master Land Use Plan provides for the implementation of the General Plan vision, goals and policies for The Platinum Triangle and will serve as a blueprint for future development and street improvements within The Platinum Triangle, including setting forth planning principles, development intensities, conceptual street, park and potential new signalized intersection locations and streetscape designs including, but not limited to, landscaping, lighting fixtures and street furniture and by identifying the existing AmtracklMetrolink Station and the conceptual Anaheim Regional Transportation Intermodal Center (ARTIC) location; and WHEREAS, on August l 7, 2004, the City Council of the City of Anaheim adopted The Platinum Triangle Master Land Use Plan by Resolution No. 2004-178 and The Platinum Triangle Standardized Development Agreement by Resolution No. 2004-179; and on August 24, ?004. the City Council adopted the Platinum Triangle Mixed Use (PTMU) Overlay Zone by Ordinance No. 5935; and WHEREAS, on July 25, 2005, the Anaheim City Planning Commission, by its Resolution No. PC2005-105, did recommend, that City Council approve an amendment to the Land L1se Element of the Anaheim General Plan, General Plan Amendment No.2005-00435, to increase the square footage of commercial development in The Platinum Triangle Area from 2,044,300 square feet to 2,049,908 square feet, an increase of 5,608 square feet, said amendment is currently being considered in connection with Amendment to The Platinum Triangle Master Land Use Plan (Miscellaneous Permit No.2005-00113 ), Zoning Code Amendment No. 2005-00044, Conditional Use Permit No. 2005-04967, Tentative Tract Map No. TTM 16800, and Development Agreement No. 2(>()5-00004 for a multiple family residential and mixed use commercial project; and 2 WHEREAS, on August 22, 2005, the Planning Commission recommended that the City Council certify Final Subsequent Environmental Impact Report No. 332 ("FSEIR No. 332")and adopt a Statement of Findings and Fact and Statement of Overriding Considerations and Updated and Modified Mitigation Monitoring Program No. 106A for The Platinum Triangle, as revised to add new mitigation measure MM 5.10-7, in connection with its consideration of General Plan Amendment No.2004-00420, Zoning Code Amendment No.2004-00036, Miscellaneous Case No. ?004-00089 to amend The Platinum Triangle Master Land Use Plan, Miscellaneous Case No. ?()OS-001 14 to amend The Platinum Triangle Standardized Development Agreement, Miscellaneous Case No. 2005-00115 torescind, in-part, the Resolution of Intent pertaining to reclassification of the North Net Fire Training Center site and Reclassification No. 2004-00134; and WHEREAS, Miscellaneous Case No.2004-00089 to amend The Platinum Triangle Master Land Use Plan (hereinafterreferred to asthe "PTMLUP") provides forthe followingchanges to the PTMLUP: an adjustment to the boundaries of the mixed-use districts to include the North Net Fire Training Center site in the PTMU Overlay Zone Gateway District and add 325 units to said district (321 of said units would be designated for the North Net Fire Training Center site); a modification to the PTMU Overlay Zone commercial density to add 210,100 square feet of additional commercial square footage including a total of 190, l 00 square feet designated for future required ground floor commercial uses along Market Street and Gene Autry Way and 20,000 square feet designated for other commercial uses in the Katella District (in the area east of State College Boulevard); and, additional technical refinements and clarifications, including, but not limited to, refinements to street cross-sections and density descriptions to reflect the above-noted changes; and WHEREAS, the Anaheim City Planning Commission did receive verified petitions for an amendment to the Land Use Element of the General Plan, designated as General Plan Amendment No. 2005-00434 to re-designate an approximately 10.4-acre property from the Office-High land use designation to the Mixed-Use land use designation; Zoning Code Amendment No. 2(H}5-00042; Amendment to The Platinum Triangle Master Land Use Plan (Misc. Case No. ?(>n5-00111); Conditional Use Permit No. 2005-04999; Development Agreement No.2005-00008; and Miscellaneous Case No. 2005-00116 to rescind in-part Resolution No. 2004-180 and Reclassification No. 2005-00164, pertaining to The Platinum Triangle (hereinafter collectively referred to as the "Discretionary Actions"); and WHEREAS, the subject properties encompassed by the Discretionary Actions comprise approximately 41.4 acres generally located between Katella Avenue and Gene Autry Way, extending from State College Boulevard to just west of Betmor Lane and further identified as Site 1: encompassing approximately 31 acres located at l 200-1558, l 700 and l 800 East Katella Avenue, 1301-1395 and 1551 Gene Autry Way,1870,1871,1880, 1881,1890,1891,1900 and 1901 South Chris Lane, 1833 and 1841 South State College Boulevard, 1800 and 1801 East Talbot Way; and Site 2: encompassing approximately 10.4 acres located at 1871,18$1,1891,1901,18701880,1890, l 900. 1901 and 1910 South Betmor Lane and 1100 East Katella Avenue; and 3 WHEREAS, Miscellaneous Case No.2005-0011 ] to amend The Platinum Triangle Master Land Use Plan is proposed to incorporate an approximately 10.4-acre property (referred to as "Site 2"), as described in Exhibit "A" attached hereto and incorporated herein by this reference, into The Platinum Triangle Mixed Use (PTMU) Overlay Zone, Katella District; and WHEREAS, the Discretionary Actions are proposed to provide for the orderly development of a Master Site Plan with up to 2,681 residences with a mix of housing types, including high rise residential towers, street townhomes, podium townhomes and lofts, with 150,000 square feet of street-related retail commercial development, public park space and associated infrastructure on Sites 1 and 2 described above; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 7, 2005, at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the .Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against (i) General Plan Amendment No.2005-00434, (ii) Amendment to The Platinum Triangle Master Land Use Plan ~ Miscellaneous Permit No. 2005-(10111), (iii) Zoning Code Amendment No. 2005-00042, (iv j Conditional Use Permit No.2005-04999, (v) Miscellaneous Case No.2005-00116 torescind in-part Resolution No. 2004-180 and Reclassification No. 2005-00164, and (vi) Development Agreement No. 2005-00008 to provide for the development of a Master Site Plan with up to 2,6$1 residences with a mix of housing types, including high rise residential towers, street townhomes, podium townhomes and lofts, with 150,000 square feet of street-related retail commercial development, public park space and associated infrastructure on Sites l and 2; and WHEREAS, on September 1, 2005, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all oral and written evidence and reports offered at said hearing, did adopt its Resolution No. PC2005-127 finding and recommending that the City Council approve Amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Permit No. 2005-(>D 11 l }based upon the findings and facts a~ set forth in Resolution No. PC2005-127; and WHEREAS, the Anaheim City Planning Commission has reviewed the proposal to amend the Platinum Triangle Master Land Use Plan (Miscellaneous Permit No. 2005-0011 l) to amend the PTMLUP to incorporate Site 2 into the Platinum Triangle Mixed Use (PTMU) Overlay Zone: and did recommend, by its resolution, that the City Council, based on its independent review oi' the Initial Study prepared in connection with the proposed Amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Permit No.2005-001 l3), and the requirements of California Environmental Quality Act ("CEQA"),including Section 2l l66 of the California Public Resources Code and Section 15162 of the CEQA Guidelines, and unless additional or contrary information is received during the public meeting, find and determine, that Final Subsequent Environmental Impact Report No. 332 ("FSEIR No. 332" ), including the Statement of Findings of Fact and Statement of Overriding Considerations and Updated and Modified Mitigation Monitoring Program No.106Afor The Platinum Triangle, as revised to add new mitigation measure MM 5.10-7, and an addendum 4 to FSEIR No. 332, together with Mitigation Monitoring Plan No. l 38, are adequate to serve as the required environmental documentation for the proposed Amendment and satisfy all the requirements of CEQA; and that no further environmental documentation need be prepared for the proposed Amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Permit No. 2005-(>O1 l 1); and WHEREAS, on September 27, 2005, the City Council held a duly noticed public hearing, gave all persons interested therein an opportunity to be heard, and independently reviewed and considered the evidence presented in the Staff Report to the City Council, including the recommendations and findings of the Anaheim City Planning Commission as set forth in Planning Commission Resolution No. PC2005-127, and the oral and written evidence presented at the City Council public hearing; and WHEREAS, the City Council, after due consideration of the recommendations and findings of the Anaheim City Planning Commission, and all evidence, testimony and reports offered at said hearing, does hereby declare and find as follows: 1. That, by its Resolution No. PC2005-126, the Planning Commission has recommended that City Council approve General Plan Amendment No. 2005-00434 to amend the Land Use Element of the Anaheim General Plan to re-designate Site 2 from the Office-High land use designation to the Mixed-Use land use designation. 2. That said amendment to The Platinum Triangle Master Land Use Plan is consistent with the vision, goals and policies for the development of The Platinum Triangle as set forth in the City of Anaheim General Plan, as proposed for amendment by General Plan Amendment No. 2005-00434. 3. That the proposed amendments to The Platinum Triangle Master Land Use Plan are consistent with the goals and intent set forth in The Platinum Triangle Master Land Use Plan. WHEREAS, pursuant to the provisions of the California Environmental Quality Act ("CEQA"), the City Council, as lead agency for the amendment to the Platinum Triangle Master Land Use Plan (Misc. Case No. 2005-OOl 11), by motion, did find and determine, based upon its independent review and consideration of an Initial Study conducted pursuant to CEQA for said Amendment, and the requirements of CEQA, including Section 21166 of the California Public Resources Code and Section 15162 of the CEQA Guidelines, and the evidence received at the public hearing, that Final Subsequent Environmental Impact Report No. 332 ("FSEIR No. 332"),including the Statement of Findings of Fact and Statement of Overriding Considerations and Updated and Modified Mitigation Monitoring Program No. 106A for The Platinum Triangle, as revised to add new mitigation measure MM 5.10-7, and an addendum to FSEIR No. 332, together with Mitigation Monitoring Plan No. 138, are adequate to serve as the required environmental documentation for said Amendment and satisfy all the requirements of CEQA; and that no further environmental 5 documentation need be prepared for the amendment to The Platinum Triangle Master Land Use Plan Miscellaneous Case No. 2005-00111); and NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Council does hereby approve Amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2005-00111), to incorporate Site 2, an approximately ] 0.4-acre property, into The Platinum Triangle Mixed Use (PTMU) Overlay Zone, Katella District. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that this Resolution is conditioned upon and will take effect upon the adoption of General Plan Amendment No. 2005-00434 and Zoning Code Amendment No. 2(}U5-()0042.
