RES-2010-106RESOLUTION NO. 2010 -106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE FIRE CHIEF, OR HIS DESIGNEE, TO SUBMIT APPLICATIONS ON BEHALF OF THE CITY OF ANAHEIM TO THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY FOR THE USED OIL PAYMENT PROGRAM (OPP), AND AUTHORIZING THE ACCEPTANCE OF SUCH PAYMENTS MADE THROUGH THE OPP ON BEHALF OF THE CITY, AND AMENDING THE BUDGET FOR THE APPLICABLE FISCAL YEAR ACCORDINGLY WHEREAS, pursuant to Public Resources Code §48690, the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, has established the Used Oil Payment Program (OPP) to make payments to qualifying jurisdictions for implementation of their used oil programs; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the OPP; and WHEREAS, CalRecycle's procedures for administering the used OPP require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the OPP. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim authorizes the Fire Chief, or his designee, to submit, on behalf of the City of Anaheim, OPP applications to CalRecycle. BE IT FURTHER RESOLVED that the Fire Chief, or his designee, is hereby authorized and empowered to take any and all necessary actions and execute in the name of the City of Anaheim all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure as aid payments to support the OPP. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby agrees to, and by this Resolution, does accept payments made through the OPP to the City of Anaheim. BE IT FURTHER RESOLVED that for any fiscal year that the City of Anaheim receives payment through the OPP, the annual budget of the City of Anaheim shall be amended by increasing the appropriations and authorized expenditures in Program No. 213 -310 in such amount as is equal to the amount of payments received by the City of Anaheim. BE IT FURTHER RESOLVED that the Finance Director is authorized to carry forward into future fiscal years any unexpended appropriations related to OPP payments. BE IT FURTHER RESOLVED that this authorization is effective until rescinded by the City Council of the City of Anaheim.
