(READVERTISED) WHBREAS, the City Planning COlIIIIlis81on of 1:I1e City of Anaheim did receive an applica~ion for a condi~ion.l us. pe~i~ from Fred Sotomayer, owner, to expand an existing Pre- School on the following described property. Beginning at the Southwest corner ot the land conveyed to Halbert A. Graham and wlre~ by deed recorded December 30, 1947 in book l6l1~ page 155 of Official Records, thence South 150 22' 30" East along the Westerly line ot said Lot One, 75 teet; thence North 730 55' 20" East 270.81 feet; thence North 150 22' 30" West, parallel with the Westerly line of said Lot One, 75 feet to a point which bears North 730 54' 25" East from the point of beginning; thence South 730 54' 25" West 270.81 feet to the point of beginning. WHEREAS, thereafter, within"twenty-two (22) days froll the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in ~ant~n2 said conditional use permit and did thereupon fix' the ~ day of ~, 19--1.5.-, as the time and the CounCIr'Cliimber in ~ o~City of Anaheim as the place for a public hearing upon said conditional use permit, and notices 'of such public heariDg were duly given as required by law and the provisions of Title . 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed. for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recomaendations of the City Planning Commis8ion and all evidence and reports offered at said hearing,'that: 1. The propoled'use i8 properly one .for wbieb a conditional use permit is authorized by the Anaheim MUnicipal C~de. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to"be located. The size and shape of the site propo8~d .for the use is ~dequate to allow the full development of the propo8ed use in a manner not det'rll1lental. to tbe particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not' imp'ose an undue burden upon the streets" and high- ways designed and improved to carry the traffic in the area. 2. 3. 4. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general w.lfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the 91ty PlanuiDg Com- mission ~~~~ said conditional use permit be, and the "8a~ ~8 6ereby susta~ned , and that Conditional U.. Permit No.. 1143 be, and the same is hereby, granted permitting the expansion of a Pre-School on the afo~edesc~ibed property with a waiver of the. following section of the Anaheim Municipal Code: s. Section 18.04.042.020 - Minimum sideyard setback (15 teet required, 5 feet proposed) That said conditional use permit is granted SUbject to the followln~ conditions: --.... 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works; and the 4o-toot butfer area on the easterly portion of the sUbject property~ which is separated by an existing chalnl1nk fence from the pre-school area~ shall not be utilized for the storage of trash, broken. glass~ or other undesirable material, and said area shall be maintained as stipulated to by the petitioner. 2. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 3. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1; provided~ .however~ that tor purposes of buffering, a solid masonry wall shall be constructed along the east property line, said wall to be six (6) teet above the highest grade level'as stipulated to by the petitioner, and that minimum five (5)-gallon size~ Arizona cypress trees, on two (2)-toot centers~ shall be planted along the east property line, and a landscaping plan for same shall be submitted to the Development Services Department ~or approval, as stipulated to by the petitioner. 4. That Conditions Nos. 1, 2, and 3, above-mentioned, shall be complied with prior to final building and zoning inspections. 5. That this conditional use permit 1s granted tor a maximum of sixty-four (64) children. . The City Council hereby reserves ~the ~1ght to revoke such Conditional Use Per~t tor good cause or failure of said owner, his heirs~ BucceS90rs or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
