A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AI:IAI-IEI!tI APPP.OVING THE ESTABLISHMENT OF
DRAINAGE FEES FOR AREAS 1 AND 2 OF DISTRICT
36 AND 37 OF THE CITY OF ANAHEIM.
WHEREAS, the City Council of the City of Anaheim has
adopted a Master Plan of Drainage pursuant to Resolution No.
74R-ll; and
y.lHEREAS, tile County Board of Supervisors of Orange
County by Resolution No. F73-65 determined that the City of
Anaheim Master Plan of Drainage to be in conformance with the
General Plan of the Oran~e County Flood Control District: and
WHEREAS, the City Council has. determined the need to
establish equitable distribution of financial contributions in
connection with the sharing of drainage obligations in Areas 1
and 2 of Districts 36 and 37 of the Master Plan of Drainage;
and.
WHEREAS, the City Council has determined the necessity
to establish drainage fees for said areas pursuant to the State
Subc-:ivisioIl !t!ap Act subject to. certain conditions.
NO~~., 'I'HEREFORE, BE IT RESOLVED by the City COWlcil of
the City of Ananeim that drainage fees for Areas land 2 of
District .36 and 37.of the City of Anaheim Master Plan of Drainage
shall be established at $1,460 per acre in the Peralta Hills Area
and $3,650 per acre in the upstream area subject.to final Co~~cil
ap~roval of the specific dollar figure and further subject to the
following conditions:
1. That the fees be paid a.t the tiIlle building permits are
issued.
2. The fees ~hall apply only to the developn\ent of new
residences on undeveloped properties, not to improvements of exist-
ing parcels or residences.
3. Tha.t the type of channel tllat would be constructed would
be an underground channel, and that the final design of the chan-
nel and accessways would be brought: back to the City Council for
approval as it pertains to any channels going th;ough the Peralta
Hills area.
