RESOLUTION NO. 75R~ 446
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT BETWEEN MATREYEK HOMES, INC.,
THE ORANGE COUNTY FLOOD CONTROL DISTRICT AND
THE CITY OF ANAHEIM PROVIDING FOR THE INST"AL-
LATION OF STORM DRAIN FACILITIES FROM TRACT
8775 TO THE HOUSTON STORM CHANNEL~ AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID AGREEMENT.
WHEREAS, the Houston Storm Channel (Orange County.
Flood Control District Facility No. A03S02) between
Brookhurst Street and Euclid Street 1s a concrete open
trapezoidal channel constructed within Orange County Flood
Control District's fee-owned right-or-way thirty feet
in width~ and is contiguous to the northerly side of the
Riverside Freeway within the City of Fullerton; and
WHEREAS~ Matreyek Homes~ Inc., owns certain real
property within the City of Anaheim, westerly of Euclid
Street along the southerly side of the Riverside Freeway,
designated as Tract 8775; and
ltffiEREAS., the City of Anaheim has approved Tract
8775 for development of the property, subject~ among other
conditions, to the requirement that adequate storm" drain
facilities be installed; and
WHEREAS, in order to provide efficient and
economical drainage facilities satisfying the City's require-
ments, reconstruction of the Orange County Flood Control
District's Houston Storm Channel 1s proposed to accommodate
construction or the tract underground drainage system
pursuant to City's Master Plan of Drainage and the require-
ments of City's Engineer; and
WHEREAS, the proposed construction appears feasible
contingent upon acceptable detailed englneeri~g plans and
specifications and reimbursement to the "Orange County Flood
Control District for construction inspection and administrative
costs; and
WHEREAS, an agreement for the installation of said
storm drain facilities has been submitted, the terms and
conditions o~ which are satisfactory to the City; and
\~EREAS, it 1s in the best interests of the City of
Anaheim to execute said agreement.

NOW, THEREFORE, BE IT RESOLVED by" the City Council
of the City of Anaheim that the agreement between Matreyek
Homes', Inc., the Orange County Flood Contr"ol District and the
City of Anaheim prOViding for the "installation of sto'rm drain
facilities from Tract 8775 to the Houston Storm Channel be,
and it is hereby~ approved.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute said agreement for and on
behalf of the City.
THE FOREGOING RESOLUTION is approved and signed by
