1975-393 RESOLUTION NO. 75R- 393 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF THAT PORTION OF CERTAIN REAL PROPERTY DESCRIBED HEREIN. WHEREAS, the City Council of the City of Anaheim did, on the 8th day of July, 1975, declare by Resolution No. 75R-349 its intention to vacate and abandon that portion of those cer- tain public alleys located between Santa Ana and Water Streets, west of Atchison Street, in the City of Anaheim, more fully hereinafter described, subject to the following conditions: 1. Reserving unto the City of Anaheim a public utility easement for existing water line, drainage facil- ities and sanitary sewer purposes together with all rights of ingress and egress in and to the north- south alley proposed for abandonment. 2. Reserving unto the City a public utility easement to cover existing power poles, power lines, anchors, cross arms and overhang wires together with all right of ingress and egress in and to the north- south alley proposed for abandonment. 3. Reserving unto the Southern California Gas Co. a public utility easement 10 feet in width to accommo- date existing gas lines together with all rights of ingress and egress in and to the parcels proposed for abandonment. 4. That the applicant will, at no cost to the Citys in- stall a gate at the south side of Santa Ana Street at the northerly terminus of the alley to be aban- doned, and that the City Public Utilities Department and Southern California Gas Co. be permitted to in- stall separate chain and lock. and did set the 29th day of Julys 1975, at 2:30 o'clock P.M. for a public hearing thereon; and WHEREAS, on said 29th day of July, 1975, at 2:30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim, said public hearing was held; and WHEREAS, the City Council finds from the evidence sub- mitted at said public hearing that that portion of the real property described herein and in said Resolution of "Intention is unnecessary for present or prospective public utility pur- poses. That that portion of the real property toward which a request for vacation and abandonment was directed is not necessary for present or prospective public utility purposes and does hereby order that said portion, as herein set forth, be and it is hereby vacated, abandoned and closed to public use, sub- ject to the conditions hereinabove set forth. 3. That said portion of real property herein ordered vacated, abandoned and closed to public. use is situ- ated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows, to wit: . That portion of those certain public alleys lying within a portion of Block C of Resubdivision of Theodore Reiser's Subdivision of Vineyard Lot G-2, as shown on a map re- corded in Book 1, pages 10 and 11, Miscellaneous Maps, records of Orange County, California, as described in Document recorded June 2, 1952 in Book 2337, page 101, Official Records, to be abandoned, described as follows: Parcel One: The westerly 35 feet of Lot 26 and the east- erly 5 teet of Lot 27 in Block C of said Subdivision. Excepting therefrom any portion thereof lying within Santa Ana Street on the north. Parcel Two: The easterly 30 feet of Lots 15 through 23 in BloCk C of said Subdivision. Reserving therefrom unto the City of Anaheim an easement for public utility purposes for electric power poles, anchors, cross arms, overhang electric power lines and an easement for water lines, water meters and drainage pur- poses together with all rights of vehicular access for in- gress and egress, over, along, under and across all of the area contained in Parcels One and Two above-described and sanitary sewer. Parcel Three: That certain 20-foot strip of land lying between Lots 14, 23, 24, 25, 26 and 27 all in Block C of said Subdivision. Reserving unto the Southern California Gas Company an easement 10 feet in width lying partially within Parcel Two and Parcel Three above-described, the centerline of said strip of land is described as follows: Commencing at the northeast corner of Lot 14 in Block C in said Subdivision; thence North 8 feet to an intersec- tion with a line parallel with and 8 feet northerly of the north line of said Lot 14, said point of intersection being the true point of beginning of the line herein de- scribed; thence Westerly along said parallel line a dis- tance of 149.50 feet to an intersection with a line paral- lel with and 5~ feet easterly of the northerly prolonga- ....; nn nF ....hl::' ~.AG""I::'.,.l v , ;nl::' nF T.nt- ?~ ;n 'Rl n,-a1,- ~ n-F GJ:li It ....... ..--..
