1975-378 ,--... RESOLUTION NO. 75R-378 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2709. 1~EREAS, after a request for variance by Katherine A. Cypr1en~ owner~ was received~ a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2709 was granted, covering the following described property: That portion of the South half of the North half of the Southwest quarter of the Northeast quarter of Section 12, Township 4 South~ Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anahe1m~ County of Orange~ State of Calirornia~ as said Section is shown on a map recorded in Book 5l~ page 10~ of Miscellaneous Maps~ in the office of the County Recorder of said County, described as follows: Beginning at the Southwest corner of said South half; thence South 890 34' 32" East, along the Southerly line of said North half, a distance of 257.00 feet; thence North 00 41' 30" East a distance of 167.80 feet; thence North 890 18' 30" West a distance of 100.00 feet; thence North 00 41' 30" East a distance of 72.00 feet; thence North 8go 18' 30" West a distance of 157.00 feet to a point on the Westerly line of said Northeast quarter distant thereon 241.00 feet from said Southwest corner of ~aid South half; thence South 00 41' 30" West, along said Westerly line, a distance of 241.00 feet to the point of beginning. ~rnEREAS, thereafter, within the time prescribed by law an interested party or the "City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property., including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because o~ special circumstances shown in (1) above, str1ct appllcatlon of the zonlng code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the Vicinity. NOW~ THEREFORE, BE IT RESOLVED by the City Council of the C~ty of Anaheim, that a conditional zoni~g variance be~ and the. same 'is hereby granted~ permitting the establishment of a five (5) lot subdivision with waivers of the following SECTION 18.26.063.030 - Minimum rear yard. (10 feet required; 7 feet proposed) SECTION 18.26.065.010 - Requirement that dwellings rear on arterial highways. (3 dwellings to front on an arterial highway) That said variance be granted, sUbject to the fOllowing conditions: 1. That this variance 1s granted subject to the completion of Reclassification No. 74-75-37. 2. In the event that sUbject property is to" be divided for the purpose of sale, lease, or financing, a parcel map to record the approved division of sUbject property "shall be submitted to and approved by the City. of Anaheim and then be recorded in the Office of the Orange County Recorder. 3. That sUbject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3 and 4; provided however~ that the building setbacks of Lots Nos. 1, 2 and 3, as shown on Exhibit No. l~ shall have a minimum depth of forty (40) feet adjacent to Sunkist Street, per City Council Policy No. 538, unless the City Council grants relief from said pOlicy and permits 25-foot setbacks for those lots proposed to front on Sunkist Street. 4. That Conditions Nos. I and 2, above~mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to. the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and/or City Council may grant. BE IT FURTHER .RESOLVED that th"e City Council hel'eb"y reserves the right to revoke such variance permit for good cause or failure of said owner, her heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance 1s granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein.
