72R-021 RESOLUTION NO. 72R-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND' DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE SOmID- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such pUblic hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein: and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and . WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 7~h day of Decfmlher ,19 -11--' and continued to the f8~h day of Januarv , 1972 , as the time, and the C1ty Council Chambers in the City HiIr in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth: and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated; and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, Countv of Oranae. State Beginning at common corner to Sections 3, 4, 9 and 10, Township 4 South, Range 9 West, S.B.B. & M.; running thence North 00 361 4511 West along Section line 708.5 feet to a point in the center of Riverside Road as paved by Orange County Highway Commission; thence ~!orth 660 16' East along the center of said road 475.68 feet; thence North 230 27' West 1070.20 feet to an old gas pipe, thence North 350 50' East along a line of gum stumps 332.60 feet to a point; thence North 80 53' West along line of old fence 446.80 feet~ thence North 720 47' East 286.65 feet to the point of beginning of pro- perty hereinafter described; running thence North 160 33' West 119.8 feet~ thence North 800 26' East 645.6 feet; thence North 110 28' West 426.7 feet; thence South 00 22' East 749.25 feet to a 2-1/2 inch iron pipe; thence South 770 08' West 1126.7 feet; and thence North 180 241 West 256.65 feet to the point of beginning. Except the East 449 feet thereof said 449 feet being measured along the Southerly line of hereinbefore des- cribed tract and the Westerly line of said Easterly 449 feet being parallel with the Easterly line of said tract. be excluded from the R-A (SC), AGRICULTURAL (Scenic Corridor) ZONE, and incorporated in the C-1 (se) , GENERAL COMMERCLAL (Scenic Corridor) ZONE, subject to the following conditions and further subject to the stipulation that the hours of operation of the service station be from 6:00 A.M. to 10:00 P.M., and the shopping center be constructed at the same time as the. service station: 1. That the owner(s) of subject property shall deed to the City of Anaheim a stri~ of land 45 feet in width fram the centerline of the street along Riverda1e Avenue and 53 feet .in width from the centerline of the street along Lakeview Avenue, and any slope easement which may be required by the City Engineer due to construction of the embankment for Lakeview Avenue, for street wideninq purposes. 2. That all engineering requirements of the City of Anaheim along Riverdale Avenue and Lakeview Avenue, including preparation of ~provement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, that street lighting facilities along River- dale Avenue and Lakeview Avenue shall be installed as required by ~e Director of Public utilities and in accordance with standard plans and specifications on file in the office of the Director of Public utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be .posted with the City to guarantee the installation of the above mentioned requirements. 3. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That all air conditioning facilities shall be prop- erly shielded from view, and the sound buffered from adjacent properties. 7. That subject property shall be served by underground utilities. 8. That drainage of subject property shall be provided in a manner satisfactory to the City Engineer. 9. That subject property shall be developed substanti.- ally in accordance with plans and specifications on file with the City of Anahe.im marked Exhibit 1-108. l, 2, 3, 4, and 5. 10. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1, 2, and 3, above mentionedr shall be completed. The provisions or rights granted by this resolution shall become null and void by act~on of the City Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant. 11. That Condition Nos. 4, 5, 6, 7, B, and 9, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
