72R-012 RESOLUTION NO. 72R-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2307. WHEREAS, after a request for variance by ATLANTIC RICHFIELD COMPANY was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2307 was denied covering the following described property: That portion of Parcel 2, in the City of Anaheim,. County of Orange, State of California, as shown on a map filed in book 30, page 48 of Parcel Maps, on file in the office of the County Recorder of said county, described as follows: Beginning at a point in the Easterly right of way line .of Imperial Highway, said point being the Southerly terminus of that certain course in said Easterly right of way line shown on said map as "North 10 23' DO" East 664.08 feet..; thence North 880 37' 00" West along said right .of way line of Imperial Highway a distance of 20.00 feet to an angle point therein; thence South 10 23' 00" West along said right of way line of Imperial Highway a distance of 13'5.76 feet; thence leaving said right of way line of Imperial Highway South 880 371 Don East at right angles to said right of way line a distance of 160.00 feet; thence North 10 231 00" East parallel with said right. of way line of Imperial Highway a distance of 136.37 feet to a point in the Southerly right of way line of La Palma Avenue 90.00 feet wide, as shown on said map, said Southerly. right of way line at said point being the arc of a curve concave Southerly having a radius of 1,355.00 feet, a radial line through said point bears North go 55' 05" East; thence Westerly along said Southerly right of way line of La Palma Avenue, through a central angle of 50 57' 02" an arc distance of 140.73 feet to a point in said Easterly right of way line of Imperial Highway; thence South 10 23' AD" West along said Easterly ri9ht of way line of Imperial Highway a distance of 14.24 feet to the Point of Beginning. Together with the Southerly half of La Palma Avenue adjoin- ing said land on the North, as said Avenue is described in the deed to the City of Anaheim, recorded May 19, 1970, in book 9293, page 261, Official Records. EXCEPTING THEREFROM that portion thereof conveyed to the State of California bv deed recorded. October 14, 1952,. in book 2395, page 522, Official Records. WHEREAS, thereafter, within the time prescribed by. law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hear- ing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That, bec.ause of special c:ircwnstances.. shown in (,1) above, strict application of the .zoning code deprives the property of privileges enjoyed by other property under identical zoning classi- fication in the vicinity. . . .......... NOW, THEREFORE, BE IT RESOLVED by the. City Council of the City of Anaheim that a condit.ional zoning. variance be, and the .same is hereby granted, permitting a se.rvice st'ation on the property hereinbefore described in a' C-l (General Commercial) (SC) Zone and granting one 20-foot free-standing si'qn (ident.ificat.ion only without prices.) on photograph on file (EXhibit 1,' Revision 1) and further granting waivers of the following Anaheim Municipal Code sections: SECTION 18 II 59 .. 041 (4.) Permi tted uses. in the .BC Zone . (service stations are required to be integrated with a shopping center, this service .station is not proposed to, be integrated with a shopping center). SECT.ION l8.59.042(1-b) Setback on arterial hi"qhways (50 feet of setback. with 20 feet of landscaping required; 18 fee.t of build'ing setback with 14 feet of landscaping proposed). SECT.ION 18.39.04,0(2) Free-standing signs in the se Zone (none permitted; 1 proposed). SECTION 18.39.040(b-2) Time limit on lighted. siC]ns (no sign pe~itted to be .liqhted between 12 midnight and 6:30 a,m.; the applicant proposes' to li.ght the sign between 12 midnight and 6 : 30 a.m.). That said variance be granted subjec~ to the follow~9 conditions: 1. That a parcel map to record the approved division of subject property be submitted to and approved by the .City of Anaheim and then be recorded in the office of .the Orange County Rec.order. 2. That trash storage areas shall be provided in accord- ance with approved plans on file with .the office of the Director of Public Works. 3. That all air-conditioning faci1ities shall be properly shielded from view, and the sound buffered. from adjacent proper- ti.es. 4. That subject property shall be served by unde~groUDd utilities. 5. That subject property shall be developed substantially in confo~ce with plans and specifications on file with the City of Anaheim marked Exhibits. Nos. 1, 2, 3~ 4, 5, 6, 7 and' 8. 6. That Condition No.1, above mentioned, shall be :...-....- 7. That Conditions Nos. 2, 3 and 4, above mentioned, shall be complied with prior to final building and zoning inspect.ions. BE IT FURTHER RESOLVED that t.he City Council hereby reserves the right to revoke such variance pe~it for good cause or failure of said owner, it.s successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the .term pre- scribed by the Anaheim Municipal Code unless otherwise specified herein.
