RESOLUTION NO. 72R-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM PINDING AND DETERMINING THAT TITLE 18 OF THE ANAIU:IM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Plannin, Commission of the City of Anahe~ did hold a public hearing in Reclassification Proceed- in9S No. 71-72-23 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zonin9, and to consider a change in the boundaries of the zone or Zones hereinafter men- tioned and described, and at said hearin9 did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 11th day of January , 19Z2-, as the time, and the City Council Chambers in the City Barr-of the City of Anaheim as ~e place for a public hearing upon said proposed amendment to Title 18 of the Anaheim MuniCipal COde; and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anahe~m Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearinq and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider ~e summary of evidence presented at said public hearing before the Planning Commission, its report of findinqs and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorpora~ed in the zone or zones as hereinafter set forth. NOW, THEREPORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and ~e same is hereby, amended and that the followinq des- cribed property, situated in the City of Anaheim, County of OrAftdA. ~~A~A n~ ~Al;~^~";~_ ~^ w~~. Parcel 1: That portion of the South half of the southwest quarter of the southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County, lying westerly of the following described line: Beginning at a point on the South line of said Section 13 easterly 464.20 feet fram tne southwest corner of said Section 13; thence North 660.18 feet along a line parallel with the West line of said Section 13, to the North line of the South half of the southwest quarter of the south- west quart.er of sa-id Section 13. EXCEPT the northerly 235.52 feet thereof. ALSO EXCEPT the southerly 235.52 feet thereof. ALSO EXCEPT that portion thereof described in a deed to the State of California recorded August 23, 1951, in book 2220, page 936 of Official Records. ALSO EXCEPT that portion tnereof lying southerly of the northerly 94.00 feet and westerly of the easterly 142 .'00 feet. Parcel 2: That portion of the South half of the southwest quarter of the southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in book 51, page 11 of Miscellaneous Maps in the Office of the County Recorder of said County, lying weste.r1y of the following described line: Beginning at a point on the South line of said Section 13, easterly 464.20 feet from the southwest corner of said section 13; thence North 660.18 feet along a line parallel with the West line of said Section 13, to the North line of the South half of the southwest quarter of the sou~- west quarter of said Section 13. EXCEPT the northerly 329.52 feet thereof. ALSO EXCEPT the southerly 235.52 feet thereof. ALSO EXCEPT the easterly 142.00 feet thereof. That street lighting facilities along Beach Boulevard shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities and that .a bond in an amount and form satisfactory to the City. of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of l5~ per front foot on Parcel 2,. along Beach BouleVard, for tree planting purposes. 4. That subject property shall be served by underground utilities. 5. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this reSolution shall become null and void by action of the Ci.ty Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant. 6. That Condition No.1, above mentioned, shall be complied with prior to final building and zoning inspections. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No.1. 8. That ordinances reclassifying the property. shall be adopted as each parcel is ready to comply wi~ conditions per- taining to such parcel, provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the Ci.ty Counci.l an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
