RESOLUTION NO. 72R-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM PINDING AND DETERMINING THAT TITLE 18 OP THE ANAHBIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- inqs No. 71-72-2Q to consider an amendment to Title 18 of the Anaheim Munic1pal Code relating to zoning, and to consider a chanqe in the boundaries of the zone or aones hereinafter men- ~ioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days followinq said hearinq, the Planninq Commission did duly adopt a resolu~ion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth, and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission ~he City Council did fix the 11th day of January 19 , as the time, and the City Council Chambers in the City Barr-of ehe Ci~y of Anaheim as ~he place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code,' and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did qive notice thereof in the manner and form provided in said Title 18 of ~he Anaheim Municipal Code; and , WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findinqs and recom- menda'tion; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adop~ed and ~at ~he proper~y hereinaf'ter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREPORE, BE IT RESOLVED by the Ci~y Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and ~e same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Oranae. State of California. to wit: That portion of the West half of the Northeast quarter of Section 1, Township 4 South, Range 11 West, in the Rancho Los Coyotes as shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, Records of Orange County. California, described as follows: Beginning at the Southwest corner of said Northeast quarter, said Southwest corner lies in the centerline of Dale Street; thence North 890 281 52ii East, 20.00 feet, along the South line of said Northeast quarter to the ~ru~~~in~~__~innin~i thence continuing North ago-28 I ~. East along said South line, 1306.35 feet, to the Southeast corner of said West half of said Northeast quarter: thence North 00 14' 47;: West along the East line of said West half, 589.15 feet to a point in the South line of the land described as Parcel 1 of Deed to the State of California, recorded April 17, 1957, in Book 3875, page 95 of Official Records; thence North 870 33~ 06': West along said South line, 1307.53 feet to the Southwesterly corner of said Parcel 1 and a point in the Northeasterly line of Parcel 2 of Deed to the S~ate of California, recorded April 17, 1957, in Book 3875, page 95 of Official Records, said Northeasterly line being a curve concave Southwesterly, having a radius of 50.00 feet~ thence Southeasterly along said curve, through a central angle of 1020 06' 03u, an arc length of 89.18 feet to the beginning of a reverse curve concave Easterly, having a radius of 50.00 feet; thence Southerly along said curve and the Easterly line of said Parcel 2, through a central angle of 280 21' 33" an arc length of 24.75 feet; thence continuing along sai~ Easterly line, South 00 131 30n East, 10.00 feet; thence South 890 461 30" West, 24.00 feet, along the South line of said Parcel 2, to a point in a line 20.00 feet Easterly of measured at right angles and parallel to the West line of said Northeast quarter, said West line being also the centerline of Dale Street; thence South 00 131 30" East along said parallel line, 551.34 feet to the tr~e p~~nt of be9inning. be excluded from the R-A, AGRICULTURAL, and M-11 LIGHT INDUS- TRIAL ZONES, and incorporated in the R-2, MULTIPLE-F~~ILY RESIDENTIAL ZONE, subject to the following conditions: 1. That a final tract map covering each proposed phase of development shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder prior to the introduction of an ordinance on each phase~ provided that ordinances reclassifying the property shall be adopted as each tract is ready to comply with conditions pertaining to such tract: and further provided that the sequence of tract development shall be such as to prevent the possibility of creating a land-locked parcel. 2. That the completion of these reclassification proceed- ings is contingent upon the granting of Conditional Use Permit No. 1277. "....~ phases of development including, but not limited to, the articles of incorporation, by-laws, proposed rules and regula- tions, methods of operation, funding, assessment, methods of management, bonding to insure maintenance of common property and buildings, and such other information as the City Attorney may desire to protect the City, its citizens, and the purchasers of the project. 4. That prior to City Council approval of the final tract map, the covenants, conditions, and restrictions for all proposed phases of development shall be submitted to and approved by the City Attorney's Office, and the approved covenants; conditions, and restrictions shall be recorded concurrently with the final tract map. 5. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department 7. That a 6-foot masonry wall shall be constructed along the east property line. 8. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered. 9. That subject property shall be served by underground utilities. 10. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5, 6 and 7, submitted with Conditional Use Permit No. 1277. 11. That Conditions Nos. 5, 6, 7, 8, 9 and 10, above mentioned, shall be complied with prior to final building and zoning ins~ections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the Citv Council an ordinance amendina Title 18 of the Anaheim Municip~l Code to accom~lish the obje~ts herein found and determined to be necessary and proper.
