A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ADOPTING AN APPLICATION FEE PURSUANT TO
SECTION 4.22.040 OF CHAPTER 4.22 OF TITLE 4 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO SMOKING
LOUNGES
WHEREAS, Chapter 4.22 of Title 4 of the Anaheim l~Iunicipal Code as adopted by City
Council Ordinance No. 5999 ("Chapter 4.22") provides that ariy business establishment within the
City of Anaheim dedicated in whole or part to the smoking of tobacco or other substances shall be
required to have a permit from the City of Anaheim issued in accordance with the requirements of
said Chapter 4.22; and
WHEREAS, Section 4.22.040 of Chapter 4.22 further prrovides that applications for permits
pursuant to said Chapter 4.22 shall include an application fee in an amount designated by resolution
of the City Council; and
WHEREAS, the City Council desires to establish the fee hereinafter specified in this
resolution as the application fee as required by Section 4.22.040 of Chapter 4.22 of Title 4; and
WHEREAS, said fee as hereinafter set forth has been considered at a duly noticed public
meeting or hearing as required by law; and
WHEREAS, the Cifiy Council finds that said fee, in the amounts hereinafter set forth in this
resolution, is less than or equal to, but in any event does not e~cceed, the actual direct and indirect
costs and expenses incurred by the City of Anaheim in receiving, processing, analyzing and acting
upon said proposed applications and permits; and
WHEREAS, the City Council further fords and determines that this resolution is exempt from
the provisions of the California Environmental Quality Act pursuant to Section 21080 (b) (8} of the
California Public Resources Code in that said fee is established to meet operating expenses,
including employee wage rates and fringe benefits and purchasing or leasing of supplies, equipment,
materials and services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANAHEIM AS FOLLOWS:
SECTION 1. SMOKING LOUNGE APPLICATION FEE.
Pursuant to the provisions of Section 4.22.040 of Chapter 4.22 of Title 4 of the Anaheim
Municipal Cade, a nonrefundable fee in the amount of $150.00 is hereby established for an
application for a smoking lounge permit within the City of Anaheim.
SECTION 2. OPERATIVE DATE.
This resolution and the fee established herein shall became operative on the date of adoption
of this resolution. The fee established herein shall apply to and amounts which become due to the
City for any service which is rendered on or after the operative date of this resolution.
THE FOREGOING RESOLUTION was approved and adopted by the City Council of
the City of Anaheim at a regular meeting of said City Council held on the ~ ~ ~ day of
