69R-344RESOLUTION NO. 69R -344 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68 -69 -85 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 3rd day of June, 1969, as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Munici- pal Code, and the exclusion of said property, hereinafter des cribed, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and did continue said hearing to June 17, 1969, for a report from the Engineering office as to possible traffic problems; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 68 -69 -85 The West half of the Southwest quarter of the Southeast quarter of Section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof re- corded in book 51, page 10, Miscellaneous Maps, records of said Orange County. EXCEPTING THEREFROM the North 30.00 feet. ALSO EXCEPTING THEREFROM the South 8 1/2 acres. ALSO EXCEPTING THEREFROM that portion described as follows: Beginning at the Northwest corner of said South. 8 1/2 acres and running thence East, along the North line of said South 8 1/2 acres, 293.00 feet; thence North, parallel with the West line of said Southeast quarter, 152.00 feet; thence West, parallel with said South line, 263.00 feet to the West line of said Southeast quarter; thence South along said West line, 152.00 feet to the point of beginning. be excluded from R -A, AGRICULTURAL ZONE, and incorporated in R -3, MULTIPLE-FAMILY 'RESIDENTIAL ZONE, subject to the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 30 feet in width, from the center line of the street, along Nutwood Street for street widening purposes, and deed a strip of land 60 feet in width for a new east -west street running between Nutwood Street and Easy Way. 2. That street improvement plans shall be prepared and all engineering requirements of the City of Anaheim, along Nutwood Street and the new east west street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property shall pay to the. City of Anaheim the sum of $2.00 per front foot, along Nutwood Street and Easy Way and the new east -west street, for street lighting purposes. 4. That the owners of subject to the City of Anaheim the foot along Nutwood Street, east -west street, for tree property shall pay sum of 15 per front Easy Way, and the new planting purposes. 5. That a Parcel Map to record the approved division of subject property be submitted to the City of Anaheim for approval and then recorded in the Office of the Orange County Recorder. 6. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a 6 -foot masonry wall shall be constructed along the south property line wherever carport walls do not exist, said wall shall be finished with slumpstone, as stipulated to by the petitioner. 9. That the owners of subject property shall deed to the City of Anaheim public utility easements and install water mains as required by the Director of Public Utilities. 10. That a modified street knuckle shall be constucted at the intersection of Crestwood Lane and Easy Way. 11. That any parking area lighting shall be lighted with down lighting of a maximum height of six (6) feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 12. That any air conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffered from adjacent residential homes. 13. That a mutual easement agreement for common drive- ways and a parking covenant for mutually shared parking spaces, subject to the review and approval of the. City Attorney, be filed and recorded in the event Parcel 1 is subdivided. 14. That Conditions Nos. 1, 2, 3 and 4 above- mentioned shall be complied within a period of 180 days from the date hereof, or such further time as the City Council may grant. 15. That Conditions Nos. 5, 6, 7, 8, 9, 10, 11, 12, and 13, above mentioned shall be complied with prior to final building and zoning inspections. 16. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertaining to such parcel; PROVIDED, HOWEVER, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
