69R-309WHEREAS, the City Council did heretofore, to wit: on
January 7, 1969, adopt Resolution No. 69R -5 in Reclassification
Proceedings No. 68 -69 -51 finding and determining that as to the
property therein described Title 18 of the Anaheim Municipal Code
relating to zoning should be amended and that the boundaries of
certain zones should be changed, subject to certain conditions
set forth in said resolution; and
WHEREAS, Condition No. 3 of said resolution reads as
follows:

That deed restrictions limiting the buildings
constructed on subject property to one story
in height shall be submitted to the City
Council for approval, and then recorded in
the Office of the Orange County Recorder."
AND, WHEREAS, Condition No. 8 of said Resolution reads as
"8. That the owner of subject property shall pay
to the City of Anaheim the sum of $150.00 per
apartment unit, to be used for park and recre-
ation purposes, said amount to be paid at the
time the building permit is issued."
AND, WHEREAS, the owner of subject property has requested
that Condition No. 3 be deleted from Resolution No. 69R -5, and
that Condition No. 8 be amended to require parks and recreation
in lieu fees in the amount of $75.00 per unit; and
WHEREAS, the City Council finds after proper notice and
hearing that said requests should be granted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 69R -5 in Reclassification
Proceedings No. 68 -69 -51 be, and the same is hereby amended by
deleting therefrom Condition No. 3 as it applies to Parcel B, pur-
suant to Ordinance No. 1338 and Reclassification Proceedings No.
58 -59 -7.
BE IT FURTHER RESOLVED that Condition No. 8 be amended
to read as follows:
"8
That the owner of subject property shall pay
to the City of Anaheim the sum of $75.00 per
apartment unit, to be used for park and recrea-
tion purposes, said amount to be paid at the
time the building permit is issued."
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 69R -5 be, and remain in full force and effect.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of May, 1969.
