69R-302RESOLUTION NO. 69R- 302 A RESOLUTION OF THE CITY COUNCIL OF THE. CITY OF ANAHEIM INITIATING PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRI- TORY AS BROADWAY BROOKHURST ANNEXATION; SETTING FORTH ITS REASONS FOR DESIRING ANNEXA- TION; ACKNOWLEDGING CONSENT OF 100% OF PROPERTY OWNERS WITHIN SAID TERRITORY; DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR, AND PLACE WHERE. AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN THE CITY WHO DOES NOT ALSO OWN PROPERTY IN THE TERRITORY SO PROPOSED TO. BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, on February 14, 1969, in its Resolution No. 69-24, the Local Agency Formation Commission of Orange County, California, did approve the proposed annexation to the City of Anaheim designated the Broadway Brookhurst Annexation and did waive the restriction of Subdivision 1 of Section 35002.3 and the restriction of Section 35326 of the Government Code as to said annexation; and WHEREAS, on or about May 13, 1969, the owners of 100% of the land within the territory proposed to be annexed consented to said annexation; and WHEREAS, the City Council of the City of. Anaheim finds that it is in in the best interests of the City of Anaheim to initiate under Government Code Sections 35310 and 35310.1 the territory designated as Broadway Brookhurst Annexation; and WHEREAS, said City Council further finds that said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, is conti- guous to the City of Anaheim, is uninhabited territory, and is described in words and figures in this resolution; and WHEREAS, the said City Council finds and does herein set forth its reasons for desiring annexation as follows: the public utility services, fire and police and other municipal services are adjacent to or pass through the territory proposed to be annexed; that said territory is ready for immediate devel- opment and must be annexed to the City so that said essential services may be extended to it; and WHEREAS, the said City Council finds from the resolu- tion of the Local Agency Formation Commission of Orange County, California, and from evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: Beginning at a point in the existing City limit line of the City of Anaheim, as established by the Orange Avenue Annexation to said City, passed by Ordinance No. 914 August 10, 1954 and filed with the Secretary of State October 18, 1954, said point of beginning being distant from the Southeast corner of the North half of the Northeast quarter of Section 12, Town- ship 4 South, Range 10 West, S.B.B. M., said South- east corner being, for the purpose of this description the centerline intersection of Brookhurst Street and Broadway, the following courses and distances: South 88° 58' 40" West 30 feet, North 0° 07' 30" West 20 feet; thence South 88° 58' 40" West 1290.20 feet, leaving the said existing City limit line of the City of Anaheim, and following along a line parallel with and 20 feet Northerly of the centerline of said Broad- way, to an intersection with the Easterly line of the Northwest quarter of the Northeast quarter of said Section 18, said point of intersection being a point in the existing City limit line of the City of Anaheim, as established by the Broadway -La Palma Annexation, passed by. Ordinance No. 1492, August 2, 1960, and filed with the Secretary of State September 2, 1960; thence North 0° 07' 55" West 646.74 feet, following along a portion of the last mentioned existing City limit line of the City of Anaheim, being a portion of the Easterly line of the Northwest quarter of the Northeast quarter of said Section 18, to an inter- section with the North line of the South half of the Northeast quarter of the Northeast quarter of said Section 18; thence North 88° 58' 20 East .1,29 feet, leaving the last mentioned City limit line of the City of Anaheim and following along a portion of the North line of the South half of the Northeast quarter of the Northeast quarter of said Section 18, to an intersection with a line parallel with and 30 feet Westerly of the centerline of the aforementioned Brookhurst Street, said point of intersection also being a point in the existing City limit line of the City of Anaheim, said point being the Southeast cor- ner of the Brookhurst Lincoln Annexation to the City of Anaheim passed March 25, 1958 by Ordinance No. 1227 and filed with the Secretary of State April 25, 1958, said Southeast corner of the Brookhurst- Lincoln Annexa- tion also being a point in the existing City limit line of the City of Anaheim, as established by the afore- mentioned Orange. Avenue Annexation; thence South 0° 07' 30" East 646.87 feet, leaving the existing City limit line of the City of Anaheim established by the afore- mentioned Brookhurst Lincoln Annexation and following along the last mentioned parallel line, being a portion of the existing City limit line of the City of Anaheim, as established by said Orange Avenue Annexation, to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as Broadway- Brookhurst Annexation and that notice of such proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not more than thirty (30) days after the passage of this resolution, in compliance with Section 35310.1 of the Government Code. AND BE IT FURTHER RESOLVED that the. City Council does find that the owner or owners of all of the territory proposed to be annexed have petitioned for annexation or filed their consents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 27th day of May 1969, at the hour of 1:30 o'clock P.M. at the City Council Chamber in the City. Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner of real property within the City who does not also own property in the territory proposed to be annexed. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized and directed to cause a copy of this resolution to be published in a newspaper of general circulation published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and that such publication shall be completed at least four (4) days prior to the date of hearing hereinabove specified.
