A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING AN EASEMENT
GRANT DEED OVER CERTAIN REAL PROPERTY
AND AUTHORIZING AND DIRECTING PAYMENT
THEREFOR.
WHEREAS, the City of Anaheim has heretofore carried
on negotiations with Thomas E. Heffernan, Executor of the Estate
of Marie Elizabeth Borchard, deceased, to secure an easement
for public utility purposes over certain real property in the
City of Anaheim; and
WHEREAS, said Thomas E. Heffernan as such Executor
has secured the permission of the Superior Court of Orange County
to execute an easement grant deed on behalf of the estate; and
WHEREAS, said deed has been executed and tendered
to the City; and
WHEREAS, the City has agreed to pay to the estate
of Marie Elizabeth Borchard the sum of $555.00 for the loss
of or damages to any and all orange trees within the easement
granted to the City of Anaheim; and
WHEREAS, the City Council finds that it is in the
best interest of the City to accept said deed and to authorize
and direct the payment of said sum of money.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that it accept and it does hereby accept
that certain easement grant deed in favor of the City of Anaheim
dated August 8, 1967 and granting to the City of Anaheim an
easement for public utility purposes over, under and across
the most northerly 30 feet of the following described parcel
of land in the City of Anaheim, County of Orange, State of
California:
Parcel 1: Beginning at a point 281.32 feet East of
the common corner of Sections one (1), two (2), eleven
(11) and twelve (12), Township four (4) South, Range
nine (9) West, S.B.B. &M., running thence North 2137.52
feet to a point in the center line of the Santa
Ana Valley Irrigation Company's Canal; thence North-
easterly along the line of said canal to the Northeast
corner of the 25 acre tract of land conveyed by Alice
C. Turner, Lizzie Hay Inch and Thomas L. Inch, Executors
of the Last Will of James A. Turner, deceased, to Leo
Borchard by deed recorded April 20th, 1920 in Book 359,
page 91 of Deeds, records of Orange County, California;
thence South along the East line of said 25 acre tract
23132.96 feet to the Southeast corner of said 25 acre
tract; thence West 613.97 feet to the point of beginning.
Parcel 2: An undivided one -half interest in and to a
parcel of land described as beginningat a point on the
West line of Lot one (1) of the land owned by E. Walter
Pyne, as shown on a Licensed Surveyor's Map filed in
Book 2, page 19 of Records of Surveys in the office of
the County Recorder of Orange County, California 920
feet North 0° 16' West from Southwest corner of said
Lot one (1); thence North 0° 16' West 60 feet; thence
West 60 feet; thence South 0° 16' East 60 feet; thence
East 60 feet to the point of beginning.
Parcel 3: An undivided one-half interest in and to a
right of way for ingress and egress to and from Parcel 2
and for the construction and maintenance on said right
of way of a pipe line over andrupon a strip of land 10
feet wide described as beginning at the Southwest corner
of said Lot One (1) of the land owned by E. Walter Pyne;
running thence North 0° 16 West along said West line
of said Lot One (1), 920 feet; thence West 10 feet; thence
South 0 16' East 920 feet; thence East 10 feet to the
point of beginning;
and the City Clerk be and she is hereby authorized and directed
to cause said easement grant deed to be recorded.
BE IT FURTHER RESOLVED that the City Clerk be and
she is hereby authorized and directed to record with said easement
grant deed Order of the Superior Court of the State of
California authorizing conveyance of easement for public use.
AND BE IT FU,7HER RES VED that the Finance Director
be and im tt''hhteb authori da d directed to draw a City
Warrant chargeable to Work Order No. 1214 made payable to Thomas
E. Heffernan, Executor of the Will of Marie Elizabeth Borchard,
deceased; and that said city warrant be delivered to the Office
of the City Attorney for transmittal.
THE FOREGOING RESOLUTION is approved and signed by
me this 8th day of April, 1969.
