A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND DIRECTING
THE COMPROMISE OF CERTAIN EMINENT DOMAIN
LITIGATION AND DIRECTING THE FINANCE
DIRECTOR TO MAKE CERTAIN PAYMENTS IN
CONNECTION THEREWITH.
WHEREAS, heretofore, by its resolution duly adopted
and passed on the 20th day of August, 1968 the City of Anaheim
authorized and directed the initiation of condemnation proceedings
which resulted in the commencement of Orange County Superior
Court Case No. 162758, being entitled "City of Anaheim vs Philip
0. Vulliet, et ux, et al and
WHEREAS, defendants Philip 0. Vulliet, and Evelyn D.
Vulliet have offered to deed the property sought to be condemned
by the City of Anaheim to the City for a total cash consideration
of $17,500.00; and
WHEREAS,. the City Council of the City of Anaheim finds
that the sum of $17,500.00 is a fair and reasonable amount to
be paid for the property condemned; and
WHEREAS, said defendants have tendered to the City of
Anaheim their grant deed covering said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it does hereby accept that certain
easement deed to which reference has been made covering the
following described property:
All that certain real property situated in the City
of Anaheim, County of Orange, State of California,
described as follows:
PARCEL ONE: Lot 29 of Tract No. 3216, in the City
of Anaheim, County of Orange, State of California,
as per Map recorded in Book 97, pages 21 and 22 of
Miscellaneous Maps, records of said Orange County.
Except that portion thereof described as follows:
Beginning at the Southerly corner of said Lot 29,
said point being on a curve concave Westerly having
a radius of 50.00 feet, a radial line at said point
bears South 85° 57' 01" East; thence Northerly along
said curve through a central angle of 6° 39' 26" a
distance of 5.81 feet; thence North 50° 19' 46" East
44.73 feet; thence North 80° 12' 29" East 8.82 feet
to a point in the Southeasterly line of said Lot 29,
said point being located 56.14 feet North 50° 17' 54"
East from the South corner of said Lot 29; thence
South 50 17' 54" West 56.14 feet along the South-
easterly line of said Lot 29. to the point of beginning.
PARCEL TWO: That portion of Lot 28 of Tract No. 3216,
in the City of Anaheim, County of Orange, State of
California, as per Map thereof recorded in Book 97,
pages 21 and 22 of Miscellaneous Maps, records of
said Orange County, described as follows: Beginning
at the Northerly corner of said Lot 28; thence South
0° 55' 48" East 40.00 feet along the East line of said
Lot 28; thence South 80° 12' 29" West 62.54 feet to a
point in the. Northwesterly line of said Lot 28, said
point being located 56.14 feet North 50° 17' 54" East
from the Northwest corner of said Lot 28; thence North
50° 17' 54" East 79.26 feet along the Northwesterly
line of said Lot 28 to the point of beginning.
and that the City Clerk be, and she is hereby authorized and
directed to record said deed.
BE IT FURTHER RESOLVED that the Director of Finance be,
and he is hereby authorized and directed, to deliver to the
City Attorney's Office a warrant in the amount of $17,500.00
payable to Philip O. Vulliet and Evelyn D. Vulliet, husband and
wife, and Gordon B. Severance, their attorney, said warrant to
be delivered by the City Attorney to said defendants and their
attorney when the City Attorney holds-an easement deed in favor
of the City conveying the property condemned.
THE FOREGOING RESOLUTION is approved and signed by
me this 8th day of April, 1969.
