RESOLUTION NO. 63R- 883
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING ISSUANCE OF
A PURCHASE ORDER TO COMPENSATE SOUTHERN
CALIFORNIA EDISON COMPANY FOR PHYSICAL
SEVERANCE OF PORTIONS OF ITS ELECTRIC
SYSTEM UNDER CERTAIN CONDITIONS.
WHEREAS, there is pending before the Superior Court
of Orange County Case No. 117511, entitled "City of Anaheim v.
Southern California Edison Company, et al.," under which the
City is condemning certain facilities of said Edison Company;
and
WHEREAS, prior to the entry of Final Judgment and
Final Order of Condemnation in said case, it will be both
agreeable and economically sound to make the transfer over
of facilities from said Edison Company to the City; and
WHEREAS, said physical severance has been deter-
mined to cost the sum of $36,343.90 which said sum will be
included in the Final Judgment and Order of Condemnation; and
WHEREAS, it is the desire of the City, in order to
expedite the Orderly transfer of said facilities to the City
in advance of said final judgment of condemnation, to authorize
a purchase order in favor of Southern California Edison Company
in the amount of $36,343.90 to reimburse said company for
relocating, rearranging and reconstructing certain electric
distribution facilities in the City of Anaheim in the event
final judgment is not entered in said Superior Court Case No.
117511; and
WHEREAS, the Southern California Edison Company will
return such purchase order unused upon entry by the City of
final judgment in said Case No. 117511.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that its Finance Director be, and he is
hereby, ordered and directed to issue a purchase order to
Southern California Edison Company in the amount of $36,343.90
subject to the provisions and conditions hereinabove set forth.
THE FOREGOING RESOLUTION is approved and signed by
me this 5th day of November, 1963.
