63-0958A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING AND DIRECTING THE PAY
MENT' OF TAXES ON CERTAIN 'REAL PROPERTY ACQUIRED
THROUGH EMINENT DOMAIN FROM THE DYKE WATER
COMPANY.
WHEREAS, the City of Anaheim, in Superior Court Action
No. 111149, being "City of Anaheim v. Dyke Water Company, et al.,"
did condemn through eminent domain certain real property of the
Dyke Water Company; and
WHEREAS, in connection therewith the Title Insurance
and Trust Company is holding in its Escrow No. 345591 -ET the pro-
rated share of Dyke Water Company of the taxes due against said
properties in the amount of $5,984.49, which said amount will be
paid to the City prior to December 10 1963; and
WHEREAS, the total taxes levied against the said prop-
erty of Dyke Water Company acquired by the City of Anaheim as
aforesaid amount to $14,300.61, which said amount must be paid
prior to the 10th day of December, 1963; and
WHEREAS, as to the portion of said properties lying
within the corporate limits of the City of Anaheim, the taxes may
be canceled and any payments thereon refunded tb th0 City of
Anaheim; however, as to the lesser portion of said properties
lying outside the corporate limits of the City of Anaheim, no
cancellation nor refund can be made; and
WHEREAS, segregation of those properties upon which
refund can be made will be accomplished as soon as possible, but
cannot be made prior to December 10, 1963, and the taxes will be
a continuing obligation of the remaining properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Finance Director be, and he is hereby
authorized and directed to draw a warrant of the City of Anaheim
in favor of the County Tax Collector in the amount of $14,300.61
and cause the same to be paid prior to 5 P. M. on December 10,
1963.
THE FOREGOING RESOLUTION is approved and signed by me
