RESOLUTION NO. 7lR- 549
A RESOLUTION OF THE CrTY COUNCIL OF THE. CITY
OF ANAHEIM APPROVING THE TERMS AND COND.ITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH VANNA R. AND ANN S. ALPETER.
WHEREAS, Vanna R. Alpeter and Ann S. Alpeter, husband
and wife, are the owners of propert.y in the City of Anaheim over
which. the City owns an easement for public utility purposes; and
WHEREAS, Vanna R. and Ann S. Alpeter wish to build a
swimming pool over a portion of the said easement of the City;
and
WHEREAS, unless Vanna R. and Ann S. Alpeter are allowed
to encroach upon the. easement of the 'City, an extreme and undue
hardship will be caused to them; and
WHEREAS, the proposed encroach..ment to build a swimming
pool across a portion of the easement of the City will not inter-
fere with the. present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City' Council of
the City of Anaheim that the terms and conditions of a license
agreement between ~e City of Anaheim and Vanna R. and Ann S.
Alpeter dated December 28 I 197'L, be, and the same are
hereby approved.
BE IT FURTHER RE.SOLVED that the Mayor and City Clerk
are hereby authorized to execute said license agreement on behalf
of the City of Anaheim.
