71R-548 RESOLUTION NO. 71R-548 A RESOLUTrON OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2298. WHEREAS, after a request for variance by GRACE BAPTIST CHURCH., OWner; WYMAN ZANDER, Agent, was received, a public hear- ing before the Planning Commission of the 'City of Anaheim was held upon due and proper notice as 'a result of which Variance No. 2298 was denied covering the following described property: That portion of the North half of the Northwest quart.er of the Northwest quarter of Section 7, Township 4 South, Range 10 West, in the City of Anaheim, as said section is shown on a Map recorded in Book 51, page 10 of Mis- cellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point on the North line of said North- west quarter, 666.00 feet East of the Northwest corner of the Northwest quarter of said Section 7~ thence South 586.00 feet parallel with the West line of said section 7; thence East 180 feet parallel with the North line of said section 7; thence North 536.00 feet paral- lel with the West line of said Section to the North line of said Northwest quarter; thence West 180.00 feet along said North line of said Section 7 to the point of beginning. WHE~S, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning commission action at a public hear- ing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RE.50LVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the subdivision of an existing parcel into two lots, one of lots to be used for the construction of church executive offices on the property' hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.16.020 Pe~itted buildings and uses in the R-A Zone. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That all air conditioninq facilities 'shall be properly shielded from view, and the sound buffered from adjacent properties. 4. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 5. That a modified cul-de-sac shall be provided at. 'the terminus of Haron Street subje'ct to the approval of the City Enqineer. 6. That the owners of subject property shall pay ~o ~e City of Anaheim the sum of 159 per front foot alonq La Palma Avenue for tree planting purposes. 7. That subject property shall be se,rved by underground utilities. 8. That any parking area lighting proposed shall be down- lighting of a maximum height of 6 feet, which lighting shall be directed away fram the property 1ines to protect the residential inteqrity of the area. 9. That subject. property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 and 2. 10. That the applicant prepare and record with 'the Orange County Recorder an agreement in a form satisfactory to the 'City Attorney that the church or the owner of the large parcel will assume ownership and occupancy of the property in question at such time as the district offices may be relocated. -2- ..~'la'HIi...-.r....._."~:~ ...- ll. Tha,i; Conditions Nos. 4, 6, and 10, above mentioned, shall be complied witn prior to the commencement of the 'activity authorized under this resolution, or prior to the time that the buildinq permit is issued, or within a period of 180 days fram date, he,reof, whichever occurs first, or such 'further time as the City Council may grant. 12. That Conditions Nos. 1, 2, 3, 5, 7, 8 and 9, above mentioned, shall be complied with prior to final building and zoning inspection. BE IT FURTHER RESOLVED that t.he Ci,ty Council hereby reserves the right to revoke such variance permit ,for good cause or failure" of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal COde and regu1a'tions and the conditions herein. Said variance is granted for the t~ pre- sc'ribed by the Anaheim Municipal Code unle'ss' otherwise specified herein.
