the Re-subdivision of said Theodore Reiser's Subdivision.
Reserving therefrom an easement for public .uti.li ty pur-
poses including, but not limited to, sanitary sewers,
sto~ drain and drainage ditch over, under and across
all of the land above described.
4. That said vacation and abandonment herein described
be granted subject to the following conditi.ons:
(a) That a public utility. easement .be reserved
across the enti.re parcel for existing utili ties
including, but not limited to, sanitary sewer,
drainage ditch, water lines and storm drains
together with all rights of ingress and egress
to same, and that no permanent structures.
or buildings be constructed across said ease-
ment.
(b) That the applicant agrees to accept surface
flow and runoff water from .surrounding pro-
perties and execute a hold ha~less agreement
to be prepared by the City Attorney's Office
to absolve the City of Anaheim from any
liability and/or damages.
(c) That the applicant relocate the existing
chain link fence now located along the
northerly line of Water Street to the
southerly line of said street, and that
gates be provided at both the west and east
terminus of said street to provide access
to the Kwikset property for emergency fire
fighting equipment.
AND BE IT FURTHER RESOLVED that the city Clerk be and
she is hereby authorized and directed to cause a certified copy
of this Resolution and Order, attested by her under the seal of
the City of Anaheim, to be recorded in the Office of the County
Recorder of Orange County, California.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ORDERING THE VACATION AND. ABANDON-
MENT OF THAT PORTION OF CERTAIN REAL PROPERTY
DESCRIBED HEREIN AND RESERVING THEREF.ROM A
CERTAIN EASEl~NT FOR PUBLIC UTILITY PURPOSES.
WHEREAS, the City Council of the city of Anaheim did,
on the 7th day of December, 1971, declare by Resolution No.
7lR-537 its intention to vacate and abandon certain real property
herein described and subject to the conditions therein described,
and did set the 28th day of December, 1971, for a public hearing
thereon; and
WHEREAS, on said 28.th day of Decemb'er, 1971, at 1:30
P.M~ in the Council Chamber in the City Hall of the City of
Anaheim, said public hearing was held; and
WHEREAS, the City Council finds from the evidence
submitted at said public hearing that that portion of the real
property described herein and in said Resolution of Intention
is unnecessary for present or prospective roadway and alley
purposes but that a certain public utility easement should be
reserved therein and subject to certain conditions hereinbelow
stated.
NOW 1 THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim:
1. That it finds that said public hearing was properly
held and that all notices were given and publications
made as required by law_
2. That that portion of the real property toward which
a request for vacation and abandonment was directed
is not necessary for present or prospective roadway
and alley purposes and does hereby order that said
portion, as herein set forth, be and it is hereby
vacated, abandoned and closed to public use.
3. That said portion of real property herein ordered
vacated, abandoned and clo'sed to public use is
situated in the City of Anaheim, County of Orange,
State of California, and is more particularly
described as follows, to wit:
That portion of dedicated roadway, commonly known as
Water Street, located in the City of Anaheim, County of
Orange, State of California; to be abandoned, described
as follows:

A of the Re-Subdivision of Theodore Reiser's Subdivision
of Vineyard Lot G-2, as shown on a map recorded in Book
