A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE. NO. 2302 IN PART.
WHEREAS, after a request for variance by Shappell
Industries was received, a public hearing before the Planning
Commi"ssion of the City of Anaheim was held upon due and proper
notice as a result of which Variance No. 2302 granted. in part,
covering the following described property:
That portion of the land allotted to Eduardo polloreno
in Decree of Partition of the Rancho Santiago De
Santa Ana, City of Anaheim, County of Orange, State
of California, rendered in Case No. 1192 and entered
September 12, 1868 in Book liB" page 410 of Judgments
of the 17th Judicial District Court of California,
described as follows:
Beginning at a point East 281.22 feet from the .common
corner of Sections 1, 2, 11 and 12, Township 4 South,
Range 9 West~ thence North 2137.52 feet to the center
line of the Santa Ana Valley Irrigation Company's
Canal; thence northeasterly along said center line to
the northeast corner of the 25 acre tract of land
described in the deed to Leo Borchard recorded April
20, 1920 in Book 359 page 91 of Deeds of said County;
thence South 2313.96 feet along the East line of said
25 acre tract to the southeast corner of said 25 acre
tract~ thence West 613.97 feet to the point of begin-
ning.
Except that portion thereof lying northerly of the
southerly line of the land described in the deeds to
the State of California recorded April 29, 1948 in Book
1758 page 341 of Official Records of said County and
recorded August 31, 1948 in book 1695 page .85 of said
Official Records.
WHEREAS, thereafter, wi thin the time pres.cr.ibed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a public
hearing noticed and held as prescribed by law and as a result
thereof the city Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2.
That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classification
in the vicinity.

NOW, THERE.FORE, BE IT RESOLVED by the City Council of
the city of Anaheim that said variance be granted in part per-
mitting a l36-lot residential subdivision on the property herein-
before described with a waiver of the following section of the
Anaheim Municipal Code for Lots 20, 21, 22 and 23 on'ly:

that said variance be qranted in part, subject to the following
conditions:
1. That a final tract map of subject property shall be
submitted to and approved. by the City Council and .then be recorded
in the office of the Orange County Recorder.
2. That subject property shall be deve10ped sUbstantially
in accordance with plans and specifications on file. with the City
of Anaheim marked Exhibits Nos. 1 "through 18, provided, however,
that all lots shall have a minimum of 7,200 square feet of area
and shall be 70 feet in width.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance pe~it for good cause
or failure of said owner, its successors or assigns to comp1y
with:.'~he...Anaheim Municipal Code and reguJ.ations and the con-
ditions herein. Said variance is granted for the te~ pre-
scribed by the Anaheim Municipal Code unless otherwise sp.ec.ified
herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 21st day of December, 1971.
