A RESOLUTION OF THE CITY COUN.CIL OF THE CI.TY
OF ANAHE.IM ACCEPTING A SEA;LED PROPOSAL AND
AWARDING A CONTRACT TO THE, LOWEST RESPONSIBLE
BIDDER FOR THE FURN.ISHING TO THE CITY OF
ANAHEIM OF WATER PI.PE AND FITTINGS.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, publls.hed and circulated in the City of Anaheim, to
wit: The Anaheim Bulletin, on NoveIQber 11t.h and 18th, 1971, a
notice inviting sealed proposals fo~ the furnishing to tne
City of Anaheim, in approximate quantities, of the following
cast iron water pipe and fittings:
ITEM V 5,000 feet of 12 inch cast iron pipe
ITEM VI 2,000 feet of 12 inch ductile iron pipe
ITEM VII 1,500 feet of 16 inch ductile iron pipe
ITEM VIII 50,000 pounds of Mechanical Joint fittings
with accessories.
AND WHEREAS, said notice did provide that said pipe
and fittings shall be in accordance with "Speci.fications for
Cast Iron Water Pipe, Series of 1971 - City of Anaheim"; and
WHEREAS, such notice inviting proposals for said cast
iron water pipe and fittings did provide that said sealed
proposals would be received by the City of Anaheim at the office
of the City Clerk of said City up to the hour of 2:00 o'clock
P.M. on November 24, 1971, for the furniShing to said City of
said water pipe and fittings~ and
WHEREAS, the City Clerk of the Ci ty of Anaheim did
receive sealed proposals prior to 2:00 o'clock P.M. on November 24,
1971, for the furnishing of said water pipe and fittings, which
proposals were opened on said date in public in the City Council
chambers in the City Hall, in the City of Anaheim by the City
Clerk and the Purchasing Agent, and duly tabulated by the Pur-
chasing Agent and the result thereof reported to the City Council
at its next regular meeting, for action thereon by said City
Council. That sealed proposals were received fram the following
persons, firms or corporations in the amounts set forth:

AND WHEREAS, the City Council does -find that the
sealed proposal of the United States Pipe and Foundry Company,
l205 Air Way, Glendale, California, 91201, is the lowest
responsible bid for the furnishing of cast iron water pipe and
fittings, specified in Items V, VI, VI.l and VlrI of the notice
invitinq sealed proposals and in accordance with .the specifica-
tions set forth in said notice inviting sealed proposals, and
that said proposal of United States Pipe and Foundry Company
should be accepted and a contract awarded to said company, for
furnishing said pipe and fittings to the City. of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said proposal submitted by the United
States Pipe and Foundry Company for the furnishing of said water
pipe and fittings, as specified in the notice inviting sealed
proposals therefor and in accordance with and conformity to
~'Specifications for Cast Iron Water Pipe, Series 1971 - City of
Anaheim,u be, and the same is hereby accepted and that. a contract.
for the furnishing of said water pipe and fittings be., and the
same is hereby, awarded to said United States Pipe and Foundry
Company; and
BE IT FURTHER RESOLVED that the award of a contract to
said United Stat.es Pipe and Foundry Company is declared to. be
for the approximate quantities set forth in the notice inviting
sealed proposals and tha~ t.he actual amounts required by the
City may be substantially more or less than these amounts; and
BE IT FURTHER RESOLVED that said united States Pipe
and Foundry Company be, and it is hereby required to. execute a
contract., in required form satisfact.ory to ~e City of Anaheim
and upon the te~s and conditions specified in the notice inviting
sealed proposals and the. proposal submitted by it, and in accord-
ance with the specifications for said water pipe and fittings
as set forth in said notice invitin9 sealed proposals for the
furniShing of said water pipe and fi ttinqs .he.reinabove more
particularly set forth, in all required lengths, at the prices
as follows. :

AND BE I.T FURTHER RE.SOLVED by' 'the Cit.y Co.uncil of the
City of Anaheim that said bid be, and the same 'is hereby accepted
and said contract awarded for the above prices for said water
pipe and fi t.tings , F. 0 . B. Anaheim., sales tax 'included, said pipe
and fittings to be delivered as required by the Ci.ty of Anaheim
during a peri.od not exceeding 12 months from date of contract.
BE IT FURTHER .RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and direct.ed to execute for and on behalf of the City of Anaheim
with .said United States Pipe and po.ndry Company a writ.ten contract
for the furnishing of said water pipe and fittings hereinabove
set forth and in accordance with the nSpecifications f'or Cast
Iron Water Pipe, Series of 19'71 - City of Anaheim, II the notice
invitinq sealed proposals and the terms of this resolution and
the contract approved by the City Attorney of the City of Anaheim;
and
BE IT FURTHER .RESOLVED that said contract: shall contain
a provision that should said United States. Pipe and Foundry Company
fail or neglect: to furnish said pipe and/or fit~9s in accordance
with said specifications and the sealed proposal sUbmitted by it
and accepted by the City as herein specified, it shall, in addition
to any other penalties provided in the contract documents, be
liable to tne City of Anaheim for all loss or damages that the
latter may suffer on account thereof. .
THE FOREGOING RESOLUTION is approved. and signed by me
this 7th day of December, 1971.
