A RESOLUT~ON OF THE CITY COUNCIL OP THE CITY
OF ANAHEIM ACC'EPTING. A S!:ALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE'
BIDDER POR THE FURNISHING TO THE CITY OF
ANAHEIM OF CAST IRON WATER PIPE.
WHEREAS, the City Council of the city of Anaheim did
cause to be published in a newspaper of general 'circula~ion,
printed, published and circulated in the City of Anaheim, to wit:
The Anaheim Bulletin, on November 11 and 18, 19'71, a notice
inviting sealed proposals for the furnishinq to the city of
Anaheim, in approximate quantiti,es, of the following cast iron
water pipe:
ITEM I 1,000 feet of 4 inch 'cast iron pipe
ITEM II 3,000 feet of 6 inch. cast 'iron pipe
ITEM III 6,000 feet of 8 inch. cast iron pipe
ITEM IV 7,000 feet of 10 inch cast iron pipe
AND WHEREAS, said notice did provide that said pipe
shall be in accordance with "Specifications 'for Cast Iron Water
Pipe, Series of 19'71 - city of' AnaheimH; and
WHEREAS, such notice inviting proposals 'for said cast
iron water pipe did provide that said sealed proposals. would be
received by the City of Anahetm at the Office. of the City Clerk
of said City up to the hour of 2:00 o'clock P.M. on November 24,
1971, for the furnishing to said City of said water pipe; and
WHEREAS, the City Clerk of the City of Anahetm did
receive sealed proposals prior to 2;00 o'clock P.M. on November
24, 1971, for the furnishinq of said cast iron water pipe, which
proposals were opened on said date in publi'c, in the City Council
Chambers in the Cit.y Hall, in the City of Anaheim, by the Cit.y
Clerk and the purchasing Agent, and duly tabulated by the
Purchasing Agent and the result thereof report.ed to t.he City
Council at its next regular meeting, for action t.hereon by said
City Council. That sealed proposals were received from the
following persons, firms or corporations in the amounts set forth:

AND WHEREAS, the City Council does. find that the
sealed proposal of the PACIFIC STATES CAST 'IRON prPE COMPANY,
6399 Wilshire Boulevard, Room 401, Los Angeles, California,
90048, is the lowest responsible' bid for the .furnishinq of cast
iron water pipe specified in Items I, II, III, and IV of the
notice inviting sealed proposals and in accordance with the
specifications set forth in said notice inviting sealed proposals
and in ~ccordance with the specifications set forth in said
notice inviting sealed proposals, and that said proposal of
Pacific States Cast Iron Pipe Company should be accepted and a
contract awarded to said company for furnishing said pipe to
the City of Anaheim. '
NOW, THEREFORE, BE IT RE.SOLVED by the City Council of
the City of Anaheim that said proposal submitted by the Pacific
States Cast Iron Pipe Company for the furnishing of cast iron
water pipe, as specified in the notice inviting sealed proposals
therefor and in accordance with and conformity to "Specifications
for Cast Iron Water Pipe, Series of 1971 - City of Anaheim," be
and the same is hereby accepted, and that ,a contract for the
furnishing of said water pipe be and the same is hereby awarded
to said Pacific states Cast Iron Pipe Company; and

BE IT PURTHER RESOLVED that the award 'of a contract to
said Pacific States Cast Iron Pipe Company is declared to be for
the approxtmate quantities set forth in the. notice inviting
sealed proposals and that the actual amounts required by the
City may be substantially more or less than these amountsJ and
BE IT FURTHER RESOLVED that said Pacific state,s Cast
Iron Pipe Company be, and it is hereby required to execute a
contract, in required form satisfactory to the 'City of Anaheim
and upon the terms and conditions specified in the notice inviting
sealed proposals and the proposal submitted by it, and in
accordance with the specifications for cast iron water pipe
as set forth in said notice inviting sealed proposals for the
furnishinq of said cast iron water pipe hereinabove more
particularly set forth, in all required lengths, at the prices
as follows:

AND BE IT FURTHER RESOLVED by the City Council 'of the
City of Anaheim that said bid be, and the same' is hereby accepted
and said contract awarded for the abOve prices for said 'cast iron
pipe, F.O.B. Anaheim, sales tax included, said pipe to be delivered
as required by the City of Anaheim during a per.iod not .exceeding
12 months fram date of contract.
BE IT FURTHER RESOLVED th.at the Mayor and the city
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute for and on behalf of the City of Anaheim
with said Pacific States Cast Iron Pipe Camp'any a written contract
for the furnishing of said cast iron water pipe he~einab.ove .set
forth and in accordance with the IISpecifications for Cast Iron
Water Pipe, Series of 1971 - City of Anaheim," the noti.ce inviting
sealed proposals' and the te~s of this resolution and the contract
approved by the City Attorney of the City of Anah~tm; and
BE IT FURTHER RESOLVED that said con~ract shall contain
a provision that should said Pacific States Cast 'Iron Pipe
Company fail or neglect to furnish said cast iron pipe in accord-
ance with said specifications and the sealed proposal submitted
by it and accepted by the City as herein specified, it shall,
in addi tien to any other penal ties provided in the con.tract
documents, be liable to the City of Anaheim for all -lo'ss' or damages
that the latter may suffer on account thereof.
