71R-498 RESOLUTION NO. 71R-498 ....... A RESOLUfION OF THE CITY COu~CIL OF THE CITY OF ~~AHEIM GRANTING VARIANCE NO. 2293, IN PART. WHEREAS, after a request for variance by A.S.A.W.A. Corporation, owner, was received, a public hearing before the Planning Commission of the City of M1aheirn was held upon due and proper notice as a result of which Variance No. 2293 was denied covering the following described property: That portion of the northwest quarter of the south- ~'lest quarter of t~le soutl1~,vest quarter of Section 13 1 Township 4 South: Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous !'laps, in the office of the County Recorder of said County, described as follows; Beginning at the northeast corner of Lot 162 of Tract ~o. 22291 as per map recorded in book 69, pages 34 to 37 inclusive of said ?1iscellaneous Maps; thence South 890 591 32 n tiest 382.07 feet to the true point of beginning~ thence North 00 10' 30" East 95.0'0 feet; thence South 890 59' 37 CI ~Jest 190 It 00 feet to the 2ast line of the West 92.00 feet of said section; thence South on 10' 30" t^1est 115.00 feet to the northwest corner of said Tract No. 2228; thence along the boundary of said tract, North 890 59' 3211 East 175.00 feet! l'lorth 00 10 I 30 I: East 20.00 feet and North 890 59' 32" East 15.00 feet to the true point of beginning. WHEREAS, t~ereaftert within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property! including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That~ because of special circumstances shown in (1) above} strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT P~SOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, in part, permitting the estab- lishment of a mobilehome sales lot and office on the property hereinbefore described with waiv~rs of the following sections of the Anaheim Municipal Code~ SECTION 18.40.020 Permitted uses (mobilehome sales lot proposed; mobilehame sales lot not permitted) -1- SECTION 18.40.020 Uses must be conducted within a building (mobilehame office pro- posed; peDmanent building required) 6-foot solid masonry wall required - 6-foot masonry wall must be erected between subject property and the R-l lots to the south, except for that property owned by the applicant .,_. SECTION 18.40.070(6-a) .-. (granted in part) - That said variance be granted, in part, subject to the following conditions, and further subject to the office mobilehome being used only in conjunction with mobilehome sales and no other use: 1. That the driveways ahall be installed along Beach Boulevard as required bv the City Engineer and in accordance with-standar~ plans and specifications on file in the office of the City Engineer. 2. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential properties. 4. That any parking araa lighting proposed shall be dO\Am-'lighting of a maximu.rn height of 6 feet, which lighting shall be directed away from the property lines to protect the residential integri~y of the area. 5. That subject progerty shall be served by underground utilities. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That drainage shall be disposed of in a manner satisfactory to the city Engineer. 8. That a time li~mitation of three (3) years shall be gran"t.ed for the use of subject property and upon requast by the petitioner, an additional period of time may be granted upon approval by the City Council. 9. That Conditions Nos. 1, 2, 3, 4, 5, 6, and 7, above mentionedJ shall be complied with prior to final building and zoning inspections. 10. That subject property shall be developed substan- tia11v in accordance with olans and suecifications on file ~"lith the city of ADaheim marked Exhibit Nos. I, 2( 3, 4; 5 and 6. BE IT FURTHER P~SOLVED that the City Council herebv reserves the right t:.o revoke sucl"i variance permit for good .<- cause or failure of said owner, its successors or assigns to comply with the Anaheim ~.1unicipal Code and regulations and the conditions herein.
