A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEINI GRAl\lTING VARIANCE NO. 2288, IN PART.
WHEREAS, after a request for variance by NOXIE L.
STEARNS and LOIS D. COOK, c/o Coldwell, Banker & 'Co., OWners;
STANLEY E. BELL, Agent, was received, a public hearing before
the Planni~g Commission of the City of Anaheim was held upon
due and proper notice as a result of which Variance No. 2288
was granted in part covering the following described property:
The North 369 feet of the Northwest quarter of the
Northwest quarter of Section 7, Township 4 South,
Range 10 West, in the City of Anaheim, County of
Orange, State of California, Rancho Los Coyotes, as
shown on a map thereof recorded in Book 51, page 10,
Miscellaneous Maps, records of said Orange County.
EXCEPTING THEREFROM the West 846 feet thereof;
ALSO EXCEPTING THEREFROM the east 79 feet thereof.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a public
hearing noticed and he.ld as prescribed by law and as a result
thereof the City Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby granted, in part, perrni.tting the con-
struction of a 56 unit apartment complex on the property herein-
before described with waiver of the following section of the
Anaheim Municipal Code:
Section 18.28.05.0 (.7-a) - Minimum distance "betwe.en buildings
(10 to 20 feet proposed; 19 to 20
feet required)
(Except as to apartments Nos. 26,
27, 28 and 29)

That said variance be granted, in part, subject to the following
conditions:

1. That this variance is gr~ted subject to the comple-
tion of Reclassification No. 71-72-12, now pending.

That subject property (P.arcel 1) shall be developed
substantially in accordance with plans and specifica-
tions on file with the City of Anaheim, marked
Exhibi ts Nos. 1, 2, 3, 4 .and 5; provided, however,
that plans shall be revised to indicate relocation
of main entrances to Apartment Nos. 26, 27, 28 and
29, and that said revised' plans are to be reviewed
by the Development Services Department to ascertain
if the entrance relocation meets the intent of or
spirit of the Anaheim Municipal Code, as stipulated
to by the petitioner.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good cause
or tailure of said owners, their heirs, successors or assigns to
comply with the Anaheim Municipal Code and regulations and the
conditions he.rein. Said variance is granted for the term pre-
scribed by the Anaheim Municipal Code unless' otherwise specified
herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 16th day of November, 1971.
