A RESOLUTI,ON OF THE CITY COUNCIL OF THE' Crry
OF ANAHEIM ACCEPTING CERTAIN EASEMENT 'AND "GRANT
DEEDS. AtJT'HORIZING PAYMENT THEREFOR AND AUTHOR-
IZING EXECUTION OF A LEASE IN CONNECTION THE.RE-
WITH (SHOZI PROPERTY - ORANGE AVENUE) .
WHEREAS, heretofore, on the 26th day of May, 1971,
eminent domain proceedings '(being Orange County Superior Court
Action No. l83,670) were commenced by the Cit.y, of Anaheim to
acquire a ten acre site for park purposas from the Shozi family;
and
WHEREAS, prior to service of summons and complaint in
said action a ne90tiated settlement was 'consumma~ed. under and
by virtue of which the Sho,zi Family did eX.ecute in favor of the
City of Anaheim ~ grant deed covering said park site and an
easement deed for road purposes on the remaining property in
consideration of t.he payment by the City of the 'sum of $432,500..00;
and
WHEREAS, the City Council finds that sa'id negotiated
settl.ement is fair and reasonable, is wi thin the appraisa'ls
submitted and is in the best interest.s 'of the City to accept;
and
WHEREAS, in connection therewith a lease back to the
Shozi family of said ten acre park site has been submitted and
the City Council finds it is in the bes.t interests. 'of the City
to execute said lease pending development of the park.
NOW, THEREFORE. BE IT RESOLVED by 'the. City Council of
the City of Anahe.im that it accept 'and i.t does, he.reby accept
said grant deed and said easement deed as .tendered by t.he. Shozi
Family and the City Clerk be and she is hereby ordered and dir-
ected to cause the same to be recorded.
BE IT .FURTHER RESOLVED that the Finance Director be
and he is hereby authorized and directed to 'draw a City warrant
in the amount of $432,500.00 payable to Dan Sho.zi, 'ratsuye Sb.ozi,
Tom Shozi, Yohko Shozi, Roy Shozi and Takeo Sho.zi and to' fontard
the same to the office of the City Attorney for transmittal.
AND BE IT FURTHER RESOLVED that the'Mayor and Ci.ty
Clerk be and they are hereby authorized and direc~ed to execute
on beha.lf of the City of Anaheim that certain lease agreement
with the Shozi Family covering the ten acre park site 1:0 which
reference has been made.
