OF ANAHEIM TERMINATING ALL PROCEEDINGS 'IN
CONNECT.ION WITH CONDITIONAL USE PERMrr' NO.
1103, AND DECLARING RESOLuTrON NO. 6'9R--209
NULL AND vom.
WHEREAS, the Ci ty Council dlid hereto.fore,' to wit,
on April 22, 19'69, adopt Resolution No. 69R-,209 granting
Conditional Use Permit No. 1103 permitting the 'eStablishment
of a spaghetti restaurant with on -sale beer and wine, with 'a
waiver of the interior side yard se~ack on ~e property therein
described, subject to certain conditions 'set forth in said
reso'lution; and
WHEREAS, to date the petitioner ha.B not exercised the
riqht granted under sa'id resolution, nor have the conditions of
approval been met; and
WHEREAS, the Anaheim City Planning Commission on
September 20, 19'71, granted Conditional Use .permit No. 126.4 to
peEmit on-sale beer and wine in conjunction with a restaurant
in Resolution No. PC 71-186, ~ereby superseding ~e 'use .
granted under Conditional Use Permit No. 1103;' and
WHEREAS, the Anaheim City Planning Conunissi'on on
September 30, 19'71, did adopt Re.solution No. PC 71-187, recom-
mending to the City Council the termination of all proceedings
on Conditional Use Pe~it No. 1103; and
WHEREAS, after careful consideration of .the ~lanning
Commission's recommendation, the City Council '~inds that 'all
proceedings in connection with Conditional Use 'Pe~it No. 1103
should be te~nqted.
NOW, THEREFORE, BE IT RE.SOLVED by the. City Council of
the City of Anaheim that all proceedings in connection with
Conditional Use Permit No. 1103 be, and 'the 's'ame .are 'hereby
terminated and that Resoluti.on No. 69R-209 be, and the same 'is
hereby declared null and void from and after ~is date.
THE FOREGOING RESOLUTION is.. approved and si'gned by me
