71R-410 RESOLUTION NO. 71R-410 ..--.. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning commission of the. City of Anaheim has heretofore duly passed and adopted a resolu~ion recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a publ.ic hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports fram persons interested therein; and WHEREAS, within a period of forty (4.0.). days following the. hearing thereon, the Planning commission did duly announce by formal resolution its findings of facts 'and declare its opinions and reasons for recommending denial of said proposed chanqe in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of'the City Planning Commission, the city Council did fix .the .8th day of June, 1971, and continued to September 14, 1971, as the time', and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusions of said property hereinafter described from the zone 'in which it is now situated, and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code: and WHEREAS, at the time and place fixed' for said public hearing, the City Council did hold and conduct ,such' public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports 'and did there- upon consider the summary of evidence presented at said public hearing before the Planning commission, its report 'of findings and recommendations~ and WHEREAS, the City Council does find and dete~ine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated; and incorporated in the zone or zones as hereinafter set forth. That portion of the Second Class Lands allotted to v. Yorba, Tamas Yorba, P. Yorba, Y. Y. de cota, and other allotments including Kalisher and Wartenberg and the B. Yorba house and vineyard land, according to a map attached to and ~de a part of the Decree 'of Partition of the Rancho Canon de Santa Ana, rendered in Case No. 1978 of the 17th Judicial District Court of Los Angeles, County, California, a certified copy of which is recorded in book 28, page 158, of Deeds of sa'id Los Angeles County, located in the County of Orange, State of Calif- ornia, described as follows: Beginning at the Northwest corner of said Second Class Land alloted to de Cota; thence Southe.rly 10753.'00 feet. along the Westerly line of said Allotment to the South- west corner of the land described in the deed from Anaheim Union Water Company to Samuel Kraemer, recorded December 3, 1906 in book 139, page 144 of Deeds; thence Easterly along the Southerly line of the land described in said deed the following courses and distances: South 890 20' East 274.80 feet, North 810 45' East 214.50 feet, South 770 50' East, 278.50 feet, South 660 50' East 378.80 feet, North 860 40' East 455.40 feet .to the Easterly line of aforementioned allotment to. said de Cotai thence leaving said Southerly line South 1061.-63 'feet along the East line of the aforementioned. allotment to the Northerly line of B. That a final tract map of subj,ect property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 2. That these reclassification proceedings are granted subject to completion of annexation of subject property to the City of Anaheim. 3. Subject property shall be developed in accordance with standards of the Scenic Corridor Overlay Zone. 4. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. land 2, above mentioned, shall be completed, and final elevations and floor-plans shall be submitted to and approved by the City Council. The pro- visions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with *ithih'.'180 days from the date hereof or such further time as the' City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and det~ined to be necessary and proper.
