A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTlt~G VARIANCE NO.
2283.
tiHEREAS, after a request for variance by Bernardo
Yorba, owner, was received, a public hearing before the Planning
Commission of the City of Anaheim was held upon due .and proper
notice as a result. of which Variance No. 22.83 was granted in
whole covering the following described property;
Lots 6, 7 and 8 of Tract No. 936 in the .City of
Anahe~, County of Orange, State of California,
as per map recorded in Book 30 Pages 1 and. 2 of
Miscellaneous Maps, in the office of the County
Recorder of said County.
Except from said Lots 7 and 8 that portion lying
Northerly of the Southerly line of the land
described in the Deeds to-the State of California
recorded May 18, 1948 in Book 16.38 Page 365 of
Official Records, recorded May 26, 1948 in Book
1643 Page 306 of Official Records and recorded
June 4, 1948 in Book 1647 Page 532, of Official
Records.
A portion of said land is included within the area
shown on a map filed in Book 74 Page 2 .of Record
of Surveys in the Office of the County Recorder
of said County.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a public
hearing noticed and held as prescribed by law and as a result
thereof the City Council does hereby make the. following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity. .
2. That, because of special circums.tances. shown in
(1) above, strict application of the. zoning code
deprives the property of privileges enjoyed. by
other property under identical zoning classifica-
tion in the vicinity.

NOW, THEREFORE, BE IT .RESOLVED by the city Council of
the City of Anaheim, that a conditional zoning variance be and
the same is hereby granted, pe~itting the establishment of a
shopping center, a theater and an automobile service .station
with a waiver of the following section of t.he Anaheim Municipal
Code:
SECTION 18.40.070

required; 556 stalls proposed).

That said variance be granted subject to the following conditions:
1. That this variance is granted subject to the
completion of Reclassification Nos. 64-65-64
and 71-72-7.
2. That subject property shall be developed sub-
stantially in accordance with plans and speci-
fications on file with the city of Anaheim,
marked Exhibits Nos. 1, 2, 3, 4, 5, 6 and 7
filed with Reclassification No. 71-72-7.
BE IT FURTHER RESOLVED that the City Council .hereby
reserves the right to revoke such variance pe~it .for good cause
or failure of said owner, his heirs, successo.rs or assi.qns to
comply with the Anaheim Municipal Code and regulations and the
conditions herein. Said variance is granted for the term pre-
scribed by the Anaheim Municipal Code unless otherwise specified
herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of September, 1971.
