RESOLUTION NO. 71R-396 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OP THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 71-72-7 to consider an amendment to Title 18 of the Anaheim Municipal Code relatinq to zoninq, and to consider a change in the boundaries of the zone or Zones hereinafter men- tioned and described, and at said hearinq did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearinq, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth: and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ninq Commission the City Council did fix the 7th day of September, 19 71, as the time, and the City Council Chambers in the City Barr-of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code,' and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code: and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recom- mendation: and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Munieipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Oranqe, State of California, to wit: -1- 71-72-7 That portion of Tract 936 in the City of Anaheim, . Orange County, California, as shown on a map thereof recorded in Book 30, page 2 of Miscellaneous Maps in the O.ffice of th.e Recorder of said county, described as follows: Beginning in the easterly line of said tract at a point distant thereon South 10 09' 57" We:st 330.00 feet from the intersection thereof with .the south li.ne of Santa Ana Canyon Road being also the north 'line of the portion of said tract as shown on the map thereof recorded in Book 74, page 2 of Records of Survey of said county~ thence South 770 28' 43" We.s.t 506.68 feet; thence South 450 45' oon West 28.00 feet to the begin- ning of a curve the radius point of which bears South 450 45' oon West 250.00 feet from said be.ginning; thence southerly and westerly 370.88 feet along said curve through a central angle of 850 00' 00"; thence South 490 151 oon East radially to said curve 28.00 feet; thence South 550 001 oon East 28.00 feet to. the begin- ning of a tangent curve concave .northerly and having a radius of 450.00 feet; thence East'erly 263.11 feet alon9 said curve through a central angle of 330 30 I 00 i~. i thence South 880 30' 00" East, tangent to said curve, 202.00 feet to said east line of'Tract 936; thence North 10 09' 57 i: East along said east line 588.00 feet. to the point of beginning. be excluded from R-A (Agricultural Zone) and incorporated in C-l (General Commercial Zone) upon the. following conditions: 1. That the owner(s} of subject property shall deed to the City of Anaheim a strip of land as requ"ired by the. Precise Alignment of Imperial Hi9hway for street and public utility purposes, said dedication to be made upon demand by the City of Anaheim. 2. That all engineering requirements of the .City of Anaheim along Imperial Highlqay, including prepara- tion of improvement plans and installation of all improvements, such as curbs and gutt:er.s,' sidewalks, street grading and pavin9, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications "on file in the. office of the City Engineer; that street lighting facilities along Imperial Highway shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and fo~ satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Imperial Highway for tree planting purposes. 4. That subject property sha.!! be served by underground utilities. -2- 5. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the offi.ce of th-e Orange County Recorder prior to issu- ance of a building permit. "",-". 6. That drainage of subject property shall be- d1:"l;posed of in a manner satisfactory t.o the City Enginee,r. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of t~he Fire Department. 8. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 9 . That any parking area lighting propose-d shall be down-lighting a maximum of 20 feet. high in accordance with approved plans submitted by the' Applicant marked Exhibi t No.6. Said lightin9' shall be direc.t.ed away from the property lines to protect the residential integrity of the area. 10'. That the unpaved portion of Santa Ana Canyon Road right-of-way and the median st'rip in Imperial High- way for the le-ngth equal to the frontage of subj ect property shall be landscaped and that plans 'for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance. Follow- ing installation and acceptance, the City of Anaheim shall assume the responsibility for maintenance of said landscaping. ll. The City Council reserves the righ.t .to delete or amend the assumption of landscape maintenance in the event Council policy changes. 12 . That dense landscaping shall be. provided in the. ease- ment area adjacent to the residential uses abutting subject property to the south. 13. That an integrated sign identifying the shopping center shall be provided as submitted to- the Planning Commiss'ion for approval and marked Exh'ibi.t No.1. 14. That subject property shall be developed substanti- ally in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6 and 7; provided! howe.ver, th'at plans for any roof-mounted equipment screenin9 sha.l1 be submitted to and approved by the Development Services Department to assure that they are in accordance with the Planning Commission's recommendations. 15. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2 and 3, above mentioned, shall be completed. The provisions 'of the rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the City Council may grant. -3- 16. That Condition Nos. 4, 6, 7, 8, 9, 10, 12, 13, and 14 shall be complied with prior to final building and zoning inspections. ,..--.... BE IT FURTHER RESOLVED that .the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title l8 of the Anaheim Municipal Code to accomplish the objects he.rein found and deter- mined to be necessary and proper.
