RESOLUTION NO. 7lR- 387
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OP ANAHEIM AUTHORIZING A SETTLEMENT OF A LAW-
SUIT AGAINST HERSEY-SPARLING METER COMPANY
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A RELEASE AND COVENANT NOT TO SUE IN
CONNECTION WITH SAID SETTLEMENT.
WHEREAS, the City of Anaheim has heretofore commenced an
action against various manufacturers of water meters in the U.s.
District Court for the Northern District of California alleqinq
the violation of certain anti-trust laws; and
WHEREAS, Rutan and Tucker of Santa Ana, California, was
re~ained as special counsel for the City ~o prosecute said action~
and
WHEREAS, said law firm has recommended that the lawsuit
be se~~led wi~h one of said defendants (Hersey-Sparling Meter Co.);
and
WHEREAS, the terms of the settlement with Hersey-Sparling
Meter Company appear to be satisfactory.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that City of Anaheim will accept the. .sum of
$1,073.25 as its share of the settlement of the alorementioned
litigation with Hersey-Sparling Meter Company.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are au~horized to execute a release and covenant not to sue on
behalf of the City of Anaheim in favor of Hersey-Sparling Meter
Company.
