RESOLUTION NO. 71R-369
A RESOLUTION OF THE CITY COUNCIL OF THE CI:TY
OF ANAHEIM GRANTING VARIANCE NO. 22.76.
WHEREAS, after a request for variance by James A.
and. Vera R. Auest, owners, was received, a public hearing-
before the Planning Commission of the City of Anaheim was
held upon due and proper notice as a result. of which, Variance
No. 2276 was qrant.ed in whole covering the- following described
property:
That portion of Lot 22 of Golden State Tract "No.
2 as shown on a Map thereof recorded in Book 4,
page 68 of Miscellaneous Maps, records of. Oranqe
County, California, more particularly described
as follows:
Beg.inning at a point in the Wes.t line of said Lot.
22, said line being considered as alonq the center
line of Acacia street., and locat.ed 526.21 feet
South of the Northwest corner of said Lot 22, said
point being the Southwest corner of the North ~8
acres of said Lot 22; running from sa-id point of
beginning East 281.85 feet along a line parallel
to the North line of said Lot. 22~. thence Sout.h .
62 . 64 feet along a line parall'el to, the said West
line of Lot 22-~ thence West 281.84 feet paralle"l "
to said North line to a point in the said West
line: thence Nort.h 62.64 feet. to t.he point of begin-
ning.
WHEREAS, thereafter, wi thin the time presc'ribed by
law an interested party or the City Council on its' own motion
caused the review of said Planning Canmisslon action at a pub-
lic hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make t.he following
findings:
1. That there are special circumstances applicable .to
the property, including size, shape, topography,
location or surroundinqs, which do not apply to
other property under identical zonin9 classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code.
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the city Council of
the City of Anaheim, that a conditional zoning variance. be, and
the same is hereby granted, permitting the use of an existing
quest house as an apartment on the property hereinbefore described
with waiver of the fo11owinq section of the Anaheim Municipal
Code:
SECTION 18.28..050 (3-b)
Minimum required floor area
(12.25 square feet required;
1,000 square. feet proposed).

That said variance be granted, subject to the following con-
ditions:
1. That this variance is granted subject to the com-
pletion of Reclassification No. 71-72-3, now
pending.
2. That subject property shall be developed substan-
tially in accordance with plans and specifications
on file with the City of Anaheim, marked Exhibit
Nos. 1 and 2.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good cause
or failure of said owners, their heirs, successors or assiqns,
to comply with the Anaheim Municipal Code and regulations and
the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 17th day of August, 1971.
