A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ro~AHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREE~reNT WITH SOUTHERN PACIFIC
TP~~SPORTATION CO}WANY WITH REFERENCE TO THE
CONSTRUCTION OF A SEWER PIPE BENEATH TPACKS
AND PROPERTY OF RAILROAD (MILE POST BM-513.08)
WHEP~AS, the Soutilern Pacific Transportation Company,
a corporation of tne State of Dela'tvare, has tendered to the
City of Anaheim an Indenture granting to the City, subject to
the reservations, covenants and conditions therein contained,
the rigllt to construct, reconstruct, maintain and operate a ten
inch (IOU) sewer pipe 'tvithin a t\'1enty-four inch (24U) casing,
beneath the tracks and property of Railroad at or near South
Anaheim, in the County of Orange, State of California, crossing
the center line of said tracks at Engineer Station 76+88, Mile
Post Bl~1-513. 08, in the location shown on the print of said
Company.s Los Angeles Division Drawing A-9906, Sheet No~ 1,
dated May 12, 1971, attached to and made a part of the Indenture
above mentioned; and
WHEPEAS, the City Council finds that said Indenture
tendered to the city to be made and entered into between the
parties I 'dould De for the benefit and in the bast interest of
the City, and should be approved.
i~OtAJ, THEREFORE, BE I'll P~SOLVED by the City Council of
'the City of Anaheim that tbe Indenture tendered to the City of
Anaheim by the Southern Pacific Transportation Company, a corpor-
ation of tlle State of DclaVlare 1 grantin.g to the Citj!, but subject
to the reservations, covenants and conditions tnerein contained,
the right to construct, reconstruct, maintain and operate a ten
inch sewer pipe within a twenty-four inch casing, beneath the
tracks and property of Railroad at or l1ear South Anaheim, in
the County of Orange, state of California, crossing the center
line of said tracks at Engineer Station 76+88, Mile Post BM-513.0S,
as hereinabove more particularly described, be, and the same is
hereby ap~roved and accepted.
BE IT FURTHER p~SOLVEn that the Mayor and the City
Clerk be, and they are nereb}-7 authorized to execute said Indenture
for and on behalf of the City of )\nalleim.
THE FOP~GOING RESOLUTION is approved and signed by me
