RESOLUTION NO. 71R-342
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE TERMS AND CONDITIONS OF AN
ENCROACHMENT PERMIT AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID ENCROACHMENT 'PER-
MIT WITH PRANCIS L, MOYLE 1\ND JANE I. MOYLE..
WHEREAS, Francis L. Moyle and Jane I. Moyle, husband
and wife, are the owners of property in the City of Anaheim over
wh.ich the City owns an easement for public utility purpose'sf and
WHEREAS, the Moyle's wish to use a portion of said
easement to construct a swimming pool, concrete decking and
related facilities such as: heater, filter and pump; and
WHEREAS, unless the Moyle's are allowed to encroach
upon the easement of the City, an extreme and undue hardship will
be caused to them; and
WHEREAS, the proposed encroachment of the swimming pool,
concrete decking and related facilities such as; heater, filter,
and pump across a portion of the easement of the City will not
interfere with the present use of the easement by the city.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Francis L. Moyle and
Jane I. Moyle dated July 27, 1971, be, and the same are hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute said license aqreement on behalf
of the City of Anaheim..
THE FOREGOING RE.50LUTION is approved and signed by me
this 27th day of July, 1971.
