71R-285 RESOLUTION NO. 71R-285 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2259. WHEREAS, after a request for variance by PHOENIX CLUB, INCORPORATED, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2259 was denied covering the following described property: All that certain land situated in the State of California, County of Orange, described as follows: That portion of Lot 4 of the Travis Tract, as shown on a map recorded in book 5, page 120 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point on the center line of Douglass Street, as described in a deed to the County of Orange, recorded October 7, 1926, in book 682, page 109 of Deeds, distant North 00 04' 30H West 743.47 feet from the intersection of said center line with the center line of Kate1la Avenue! thence South 890 32' 10 l. East 544.96 feet to the Easterlv line of said Lot 4 ~ thence North 00 14' 10 tI East along .. said Easterly line 337.35 feet to the Northeasterly corner of said Lot 4 i thence North 890 30 I 10 t: West along the Northerly line of said Lot 4, a distance of 546.80 feet to said center line of Douglass Street; thence South 00 04 I 30 ~i East along said center line 337.69 feet to the point of beginning. EXCEPTI1~G the.refrom the Easterly 263.80 feet. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to permit a dance hall and on-sale liquor sales to the public in an existing private club on the property hereinbefore described with waiver of the following section of the Anaheim Municipal Code: SECTION 18.16.020 - Permitted uses in the R-A Zone (To permit a dance hall and on-sale liquor sales to the public in an existing private club) -1- That said variance be granted, subject to the following condi- tions: 1. That street lighting facilities along Douglass Road shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Direc- tor of Public Utilities~ and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of the above-mentioned requirement. 2. That the sidewalks; curbs and gutters and driveways shall be installed and repaired along Douglass Road as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. That trash st"orage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 4. That fire hydrants shall be installed as required and determined to be necessary by the Ch~ef of the Fire Department. S. That subject property shall be developed substanti- ally in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3. 6. That Conditions Nos. 1, 2, 3, 4 and 5, above mentioned, shall be complied with prior to the approval of the ABC license or within 180 days, whichever occurs first. 7. Subject to restriction of the Club's activities to its present method of operation, restricted to members and their guests only, except for the necessary revi- sion for an on-sale license. Such restriction to preclude a public dance hall with on-sale liquor in the future, should the property be sold. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for qood cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless o~herwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 29th day of June, 1971.
