71R-284 RESOLUTION NO. 71R-284 .-- A RESOLUTI.ON OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AREA DEVELOPMENT PLAN NO. 95, EXHIBIT "BII, AS AMENDED. WHEREAS, the City Planning Commission of the City of Anaheim on July 27, 1970, in Resolution No. PC70-.l39, recommended approval of Area Development Plan No. 95, Exhibi.t nAn, subject to conditions; and WHEREAS, the City Council of the City of Anaheim on August 4, 1970, in Resolution No. 70R-392, adopted Area Develop- ment Plan No. 95, Exhibit nAu, subject to. conditions; and WHEREAS, the City Planning Commission of the City of Anaheim on June 2, 1971, did hold a public he'arinq to. consider recent development proposals wi.thin the area and further consider Area Development Plan No. 95, encompass'inq an area more part.icu- larly hereinafter described, and at said hearing did receive evidence and reports from persons interested therein and from its 'staff; and WHEREAS, within a period of forty (4.0.) days following the hearing thereon, the City Planning Commission did duly announce a formal resolution, its findings of facts and declare its opinions and reasons for recommending the adoption of Exhibit uBII as amended to replace the original Exhibit HAil approved by the City Council for Area Development Plan No. 95r and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendations 'of the City Plan- ning Commission, the City Council did fix the 29th day of June, 1971, as the time, and the City Council as the place for a public hearing upon said Area Development Plan No. 95; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such publ.ic hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that Area Deve10pment P1an No. 95, Exhibit Ha", rep1acinq former1y adopt.ed Exhibi t ~: A II, should be approved as recommended by the City Planning Commission, subject to certain conditions and amend- ing Condi~ion No. 2 thereof to read as follows: Il 2 . Tha t the 100a tions shown on Exhibit _ :-B U (as amended) are deemed to be temporarily fixed access locations, so that property owners may be assured of the build- able land that would be available to them when com- mercial development of the property is anticipated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Area Development Plan No. 95, Exhibit IIBr~, replacing formerly adopted Exhibit riAi', encompassing the following described area in the City of Anaheim, County of Orange, State of California: An area generally bounded by the west side of Euclid Street between Broadway and Orange Avenue, consisting of seven parcel.s, more or le'ss , be, and the same is hereby approved, subject to the following condit.ions: 1. That the owners of all affected parcels shall provide a 2Q.-foot wide vehicular accessway along the west bo.undaries of said parcels and 20-foot wide vehicular accessway returns to Euclid Street, as depicted on Exhibit uBI1 (as amended), as th.e parcels are proposed for commercial development, or on demand by the City; and that only three (3) permanent private. vehicular accessway returns be permitted to Euclid street to lessen the vehicular movements onto this street. 2. That the locations shown on Exhibit liB" (as amended) are deemed to be temporarily fixed access locations, so that property owners may be assured of the buildable land that would be available to them when commercial development of the property is ant.icipated. However, on proper application, further modi- fication of said Plan may be considered by the. City Council. 3. That all accessways and access returns sha.ll be installed upon demand by the City, and that mutual easement rights to and over said vehicular accessways shall be granted to and exchanged by all property owners covered in Area Develop- ment Plan No. 95, upon demand by the City; said easement rights shall be submitted to and approved by the City Attorney and then be recorded with the Orange County Re.corder. 4. That the required vehicular accessways shall' be paved in accordance with the requirements of the Directo.r of Public Works. 5. That a 6-foot masonry wall shall be. constructed along the west side of the 20-foot wide north-south accessway required along all properties encompassed in the Area Development Plan. 6. That vehicular access' rights, except at street and/or alley openings shall be dedicated to the City of Anaheim, provided, however, that temporary access to Euclid Street from the indi- vidual parcels included within Area Development Plan No. 95 shall be allowed until such time as the City demands improvements of the private vehicular accessways; further provided that the individual property owners shall enter into an agreement with the City of Anaheim to close the temporary accessways that are not in conformance with the location of the three (3) permanent access returns that are designated on Exhibit fiB" (as amended); and that portion of the temporary accessway, lying within the front setback, shall be landscaped. Said agreement shall be recorded with the Orange County Recorder's Office prior to the issuance of a building permit on an individual parcel. -2- .,.--'" THE FOREGOING RESOLUTION is approved and signed by me this 29th day of June, 1971.
